The State Secrets (Public Corruption) Exception

... the Bush Administration appears to be evolving a truly novel version of the state secrets exception. In each of these (4) cases, a state secrets defense is being interposed for the purpose of blocking the disclosure of claims of gross corruption surrounding public contracts. Why are these matters state secrets? That indeed is the riddle. The Government says they can’t tell us. Apparently if they told us, they’d have to kill us to prevent further exposure of the state secrets.

One of these cases emerges in the pages of yesterday’s Reno Gazette-Journal (http://news.rgj.com/apps/pbcs.dll/article?AID=/20070830/NEWS01/708300347/1321/NEWS):

In a ruling that could make it difficult for former eTreppid software designer Dennis Montgomery to argue his lawsuit against the company, a federal judge Wednesday granted a Department of Defense request for a protective order to ensure no material involving national security is released. All sides in the lawsuit involving eTreppid Technologies, the Reno company Gov. Jim Gibbons is accused of helping obtain defense contracts in exchange for gifts and trips, are prohibited from sharing certain information that is subject to the state secrets privilege, U.S. District Judge Philip Pro said in his order.........

Of course, the real state secret that is being protected is that the Bush Administration is corrupt to its innermost core. And the fact that it’s common knowledge doesn’t stop it from being a state secret. Moreover, if you find it out–they may still have to kill you.

In 2004, eTreppid gained a $30 million, five-year no-bid contract .....

4. Fired NV USA Bogden was investigating Rep. Jim Gibbons (R-NV) and Trepp "bring the money" honey
Fired USA Daniel Bogden was investigating the newly elected Governor of Nevada, former-Rep. Jim Gibbons (R-NV), for allegedly accepting unreported gifts and/or payments from a campaign contributor and earmark recipient, Warren Trepp. Gibbons helped Trepp get lucrative government contracts for his Reno-based company eTreppid Technologies LLC. Trepp financially supported then-congressman Gibbons' election campaign. Trepp was chief bond trader for Michael Milken, the "Junk Bond King at Drexel Burnham Lambert. Trepp paid $300 million in fines. Milken was sentenced to 10 years in prison but served less than two. The SEC alleged Trepp had "parked" $366 million in bonds for Reliance insurance company. The SEC waited until 1995 to file a complaint, nine years later, then dismissed charges against Trepp in 1999 (http://www.sec.gov/litigation/aljdec/id115cff.htm ). The SEC is in the middle of the Tenet fraud too.

Trepp founded Nevada Security Bank. Around 1999, Trepp became associated with "coingate," involving felon Thomas Noe, who purchased 500,000 shares of Greg Manning at a 36% discount in 2002 from Trepp. Noe was an Ohio Republican party fundraiser convicted of illegally funneling money to the Bush re-election campaign.

In 2004, eTreppid gained a $30 million, five-year no-bid contract from United States Special Operations Command, making ETreppid one of the largest defense contractors.

Minutes later, Mr. Trepp responds, “Don’t you ever send this kind of message to me! Erase this message from your computer right now!” Mr. Gibbons failed to disclose the cruise and travel on Mr. Trepp’s leased private jet, as required by House ethics rules...."

............... ETreppid is the company for which Gov. Jim Gibbons is being investigated concerning claims that he helped gain lucrative contracts in exchange for gifts, money and a Caribbean cruise. Gibbons has started a legal defense fund to pay his lawyers.

U.S. Magistrate Judge Valerie Cooke granted the order despite objections from lawyers for designer Dennis Montgomery, .....

ETreppid says Montgomery took the valuable source codes and the company is losing tens of thousands of dollars without it. The company's civil case in federal court has been stalled by sealed documents, a state secrets declaration, Department of Defense concerns and an unconstitutional FBI search of Montgomery's home. ............
