Nebraska State Senator Sues God

LINCOLN, Neb. - The defendant in a state senator's lawsuit is accused of causing untold death and horror and threatening to cause more still. He can be sued in Douglas County, the legislator claims, because He's everywhere.

State Sen. Ernie Chambers sued God last week. Angered by another lawsuit he considers frivolous, Chambers says he's trying to make the point that anybody can file a lawsuit against anybody.

Chambers says in his lawsuit that God has made terroristic threats against the senator and his constituents, inspired fear and caused
"widespread death, destruction and terrorization of millions upon millions of the Earth's inhabitants."

The Omaha senator, who skips morning prayers during the legislative session and often criticizes Christians, also says God has caused "fearsome floods ... horrendous hurricanes, terrifying tornadoes."

He's seeking a permanent injunction against the Almighty.

Chambers said the lawsuit was triggered by a federal suit filed against a judge who recently barred words such as "rape" and "victim" from a sexual assault trial.<snip>

Ernest W. Chambers generally known as Ernie Chambers, (born July 10, 1937) is a Nebraska state legislator from Omaha, representing legislative District 11 in North Omaha. Chambers is considered one of the Legislature's most controversial and colorful members, known for his long filibuster speeches on the Legislature floor.

Ernie Chambers is a long-time member of the North Omaha community, a historic civil rights leader in Omaha's black community, and widely-regarded as Nebraska's most prominent and outspoken black leader. He has been regarded by national media as "the Maverick of Omaha," the "angriest black man in Nebraska," and the "defender of the downtrodden".<1>

After growing up in North Omaha in the 1940s, Chambers was a barber when he first appeared in the Oscar-nominated 1966 documentary film A Time for Burning. During this period he emerged as a prominent leader throughout the community, as illustrated in his instrumental role during the 1966 riots, when he successfully negotiated concessions from the city's leaders on behalf of African American young people.<2>

First elected to the Nebraska State Legislature from Nebraska's 11th District in 1970, he was most recently reelected in 2004. On April 25, 2005, Chambers became the longest-serving state senator in the Legislature's history, with more than 37 years to his name.<3> A constitutional amendment passed in 2000 limits Nebraska state legislators to two four-year terms. Because of this, Chambers will not be allowed to seek reelection in 2008.

Chambers was the New Alliance Party candidate for U.S. Senator from Nebraska in 1988.<4>. He petitioned to be included on the ballot for Nebraska Governor in 1974<5>, and ran for Nebraska Governor in 1994, losing with just .44% of the vote.

He holds a law degree from Creighton University law school but is not a member of the bar and does not practice law. He also hosts a weekly call-in public access television show on Omaha Cox Channel 22. He has always been a non-drinker and non-smoker. He commonly wears a black or blue T-shirt in legislative sessions, rather than a suit. Ernie is also a graduate of Omaha Central High School.

To prove a point about frivolous lawsuits, on September 14, 2007, Chambers filed a lawsuit against God, seeking a permanent injunction ordering God to "cease certain harmful activities and the making of terroristic threats"<6> <7>.<snip>

4. LOL! I'm kinda likin' Senator Chambers! He's quite a character. Not only is he an activist,
he wears a black or blue T-shirt in legislative sessions, rather than a suit.:thumbsup: He's his own man. That's pretty uncommon in politics!

6. Be careful about jumping on the Ernie Chambers bandwagon.
He's a bit of a nutcase.

Regarding the lawsuit against God, I don't quite understand his intent of his protest. According to another article on the subject:

Chambers says senators periodically have offered bills prohibiting the filing of certain types of suits. He says his main objection is the constitution requires that the doors to the courthouse be open to all. Chambers said, "Thus anybody can file a lawsuit against anybody - even God."

Chambers said he decided to file this lawsuit after a suit was filed in early September in federal court against Lancaster County Judge Jeffre Cheuvront. He's the judge who was hearing a sexual assault case, where the woman wants to use the words "rape and victim" during her testimony.

So, does that mean that he's objecting to the recent suit that was filed about the words "rape" and "victim"? If so, I'd have to disagree with him on that one.

7. It seems he's angry about a "frivolous" lawsuit filed by the lady.
Chambers said Bowen's lawsuit is inappropriate because the Nebraska Supreme Court has already considered the case and federal courts follow the decisions of state supreme courts on state matters.

I honestly don't know the particulars of the Bowen case. Her case did go to the Nebraska Supreme Court.


I'm not jumping on his bandwagon. This is the first time I've ever heard of the guy and thought the article was funny. 'Senator Sues G-d?' and wears T-shirts for legislative sessions? :)

He's been in office from 1970 – 2008? He's a nut case and has been in office all those years?:scared: How did that happen? ES&S at work again?????

8. No, he's in a district where he usually faces little or no opposition.
I can't remember the last time anyone ran a serious campaign against him.

I was (mostly) joking about the bandwagon thing. Ernie is somewhat of a local legend, and he is definitely polarizing. I tend to disagree with him more often than not, but he certainly keeps the locals entertained with stuff like this. Last year, he submitted a bill to split Omaha into three school districts, largely based on race.

9. being from that state I can certainly...
I can understand the 'Earnies' of Nebraska. Born and raised there. The plains are a lot like being out at sea, you learn to roll with the waves, and make your own entertainment. Might explain why so many 'Huskers' wind up in the Navy or galivanting around in strange desolate regions of the globe!

And why does he have a problem with that?

A lawsuit that has no basis in law can be dismissed. He seeks to close the courts to certain classes of people.

That is what "frivolous" lawsuit whining is all about. It's that other people shouldn't be able to sue unless the whiner thinks they should. It's to make a little dictatorship out of their personal feelings and preferences.

Ernie should be penalized as Rule 11 allows - he's the type who is for this sort of shit. He did it, so he can take the penalty he thinks others should get.

And of course, God cannot be sued, so his initial salvo is false anyway. God is not a person.

People can be sued, but they also can sue. So what? Corporations can be sued, too.

16. God has no legal residence
Earlier this year a Romanian guy, sentenced for murder, tried to sue God for not living up to his end of the deal (protecting him from the devil). The case was denied by the courts because... God has no legal residence and therefore is not a legal person.

"anybody can file a lawsuit against anybody" Any body... a body...a being with material substance..Maybe he can send God a subpoena and try and enforce it when it gets ignored just as those that were sent to Administration officials..Republicans are becoming quite the joke aren't they?

19. It's only fair, considering that somebody once sued Satan.
I remember reading about the case in law school. I think the judge dismissed the suit on the ground that there was no showing that Satan was resident within the judicial district where the suit was brought, so he couldn't be served with process.

Chambers might avoid that problem by serving process on some church that calls itself the "House of God". What are they going to do? Deny that God lives there?

On the bright side for God, there are probably plenty of lawyers willing to defend the case without charging a fee.
