Teenage girl beaten, expelled and arrested...for dropping cake

This is going to ruin your day. A young woman of color in Los Angeles had her wrist broken by a school security officer after not cleaning up a piece of dropped birthday cake to his satisfaction. During the attack he said, "hold still nappy head."

The girl, 16 year-old Pleajhai Mervin, was subsequently expelled and arrested for littering and battery. Because as you can clearly see from the video still above, this teenage girl was battering the shit out a full grown, beefy security guard. Uh huh.

But it gets worse. When the girl's mother went to the school to complain and rightfully demand that this guard be arrested--she was arrested and suspended from her job with the school district.

Students at the scene captured the assault on their cell phones; one such student was also beaten.

Students have planned a walk-out in protest. Do your part--spread the word.

Perhaps you haven't been aware, but high school is composed of three parts. The bullying teachers with delusions of competence, the bullying psychotic students, and a mass of students as sheep-like as the Democratic Congress.

People have worshipped the supposed sanctity of the American teacher so much that they've ignored the blood under their fingernails. Now these stories are starting to come to light, and folks like you are surprised. Those of us who remember what school is like simply shrug.

I learned that respect must be earned, even by supposed superiors. And I learned how easy it is for petty tyrants to intimidate, even before Newt Gingritch.

Considering the crappy job done by teachers - in imparting knowledge, encouraging character and keeping their charges from being freaking killed - teachers had better start defining why they believe they deserve the consideration given to stray dogs, let alone human beings.

Those that didn't participate at least stood there and let it happen. And there should be an investigation of the entire team in that school for the atmosphere and leadership that allowed something like this to even be possible.

And if they have arrest authority that means they're law enforcement. So are they a division of the local police? I know many big cities have police officers in the schools.

I hope to hell that the guard and the school get hit with a huge $#@%! lawsuit and lose, big time. That guard needs to be unemployable.

The biggest promise in history has been broken. I saluted the flag. I was a goddam Boy Scout! OK, so that was before Vietnam, but there always seemed to be some restraint, some decency.

I worked in NYC schools years ago. The school security guards were attached to the police department, and their main weapon was a uniform and a walkie-talkie. I found them to be professional and effective. Assaulting a student like that would get them bounced.

I'm in Florida now. I'm not surprised that these are private guards.

(No offense meant to any alien people or beings.)

that bad behavior is fashionable. We have such low standards of conduct it's not surprising our nation is in the state it's in. Just go to the grocery store. People on their cell phones, blocking the isle with their carts oblivious to others trying to get by, or worse, not oblivious, but just don't give a damn about anyone but themselves.

And this girl was asked to pick up the cake and she chose not to, then a female security guard went to tell her again and the girl slapped the officer. Then the male officer got into it and there was no sign of a broken wrist then. There's more to this story than we know.

Everything I've read so far says that the girl was complying with him. She cleaned up the dropped cake (which she says she dropped accidentally because someone bumped into her) but the officer wasn't satisfied because she left behind a few crumbs. She said she was embarrassed and tried to walk away when he picked up a call. That's when the officer pounced on her.

I'd be interested to hear how you came up with your theory.

She was embarassed and humiliated and scared, and tried to walk away(AS SHE HAD EVERY RIGHT TO DO!). The guard broke her wrist over FUCKING CRUMBS! And Christ knows what he'd have done if the student was lesbian(even the harmless, obedient apolitical knows-her-place "Ellen" kind of lesbian who just does what she's told).

You have no reason to be defending this bastard. He's on the other side.

I hate fucking cops. This is the shit they do ALL THE TIME. The have absolutely no respect for we the people who employ them, and only view us as problems to be contained. I wish ill upon them. And I'm sure I'll get flamed by people here who have respect for the individuals they personally know who serve in law enforcement, but I'm here to say that 90% of EVERYONE in law enforcement I've ever interacted with on any level is a complete fucking creep with power issues. And yes, I know this guy is not LEA per se, but you can bet your ass he wishes he were.

In politics. In law enforcement. Americans view the abusive and unreasonable authority figure as being "strong" and "decisive" and all those other out-of-date masculine traits. Then we're shocked when these occupations attract these types and it turns out that they're not interested in protecting the innocent?

We need to change the cultural norm about what we value and demand from people in positions of power and authority. "To Protect and Serve" is on every LAPD police car. I wonder how many cops have read it.

249. Here's a better idea,
one that places every last bit of power into the hands of the students.

Have them spread the word that they all intend to dismally fail the next state-run test, and each one thereafter, until that guard is fired. There would be nothing the school administrators could do about that, and doing so could place the school's funding in jeopardy. By making a school's funding linked to test scores, the students have been given all the power- if they have the guts to take the hit on their academic records.

For students who are not going to college, this could be done with relative impunity...

most of the growers I met and talked to for a while did not give a damn about politics, they did not vote. As far as they were concerned politicians were corrupt and no one was for legalizing so they stay home on election day more than they vote one way or another. Do not forget that even in the deep south Democrats still get between 30 and 45% of the vote.

These "hicks" you deride would certainly surprise you these days, I think most of my cousins have mastered shoe-wearing and no longer spit snuff spittle onto the floor, either! We haven't had a right smart sized Klan rally or lynch mob in ages! My cousin has even mastered cipherin' so he could get into Vanderbilt!

I get sick and tired of people who have a complete inability to differentiate the behavior from the punishment. It appears to me that they are now comparing THIS incident to all the other incidents of abuse we have read about lately. There is a difference between dropping your cake and running screaming around an airport or refusing to take your seat and continuing to yell questions you don't even wait for the answers to.

NOONE DESERVES TO BE ABUSED IN THE NAME OF RESTRAINT AT THE HANDS OF THE POLICE OR THE AUTHORITIES. But sometimes people do deserve to be detained. But it does not matter how many times I write that or how I write it. People like LeviathonCrumbling choose to see "They got what they deserved."

It's really frustrating.

this to our own child, we would probably have been arrested for child abuse and the girl, and any other children still living at home, would have been removed from the home and placed in foster care. It is unbelievable that a security guard finds it necessary to manhandle a 16 year old girl over dropping a piece of cake, even if she had done it deliberately.

My daughter's very best friend in the whole world was ORPHANED by those riots.

Both his parents were killed. He was 7 years old and lived in the Japanese part of town. He went off to play one day, came back and the whole 'hood was in flames. He's mostly Mexican and 1/4 Japanese.

And all these years, the woman I thought was his mom is his aunt who adopted him.

Those riots have REAL consequences. This child was orphaned at age seven.

All because of the blacks with no economic opportunities destroying the Korean businesses in their hood.

She has also been suspended from her job at another school in the county.

The school expelled Pleajhai for five days before then having her arrested for battery and for littering (the dropping of the cake). Then they had the pupil who captured the video arrested along with his sister who was merely present at the scene.

He arrested for attacking a police officer, a felony. Filming the cop while he was violating someones rights is an attack against the cop. The cop said, "do not film me" and the person disobeyed a police order. A big no no here in Myanmar,, I mean the USA. I have worked in several schools in France and there are no security guards. There is usually one woman or man at the gate making sure that any adults coming in have a good reason to come in and making sure the students only enter/leave during the permitted times but they are not referred to as security guards. Brawls are also far less common in schools over here.

I used to roll my eyes when people sued. There has been so much
demonization of people who file lawsuits. The general public is led
to believe that people who file lawsuits are sniveling and greedy or
just plain lying.

I don't believe that anymore, like I used to, because I had a talk with a local car-repairman.

He told me that many car-repair shops use cheap parts on cars to save money.
In turn, insurance companies will list these repair shops on their "preferred
business" list--offering to directly pay the repair shop and make it easier
for the consumers. Or so it would seem...

The repair man told me that these repair shops (usually car dealerships) do the
work on the cheap and the insurance companies keep directing customers their way.
What a nice, little arrangement that fills the coffers of big business while screwing
Joe six pack.

He said that State Farm was sued by consumers in a major class-action, for using
cheap parts, "Now, State Farm doesn't use cheap parts and they do great work, because
of that lawsuit." He stated that lawsuits force companies to take responsibility for
their bad practices, cater to the customer and change bad practices.

I firmly believe that if public citizens sue people like this sickening cop--we would
have fewer of these incidents. If the police know that people will sue,
police departments will be forced to implement stricter policies, change their training and tolerate
less of this psychopathic behavior from their officers.

I can't believe he called her "nappy head". What a stupid f&%^ball. Also, the school
district was pretty stupid for firing the mother. Let's all hope she has a stellar work
record and a few good reviews under her belt.

Lawsuits---all around---for everybody!!! Here's hoping that they win a large settlement.

I truly believe that--as we see our civil rights and the Constitution erode to dust--that
lawsuits are one way we can affect change and take back power when the system treats us
unfairly.

It's getting to be more and more the case that policemen and others like that are getting more and more bizarre stories told about them, when they try to take anyone into custody who is being a problem.

Sometimes it's real...but more and more often I'm seeing stories where the arrested person really WAS disrupting the peace or resisting arrest or whatever.

I'll wait for the full story in the AP, when more facts are there. I don't want to jump on the bandwagon against those who I would WANT to arrest someone who is breaking the law or disrupting the peace when I'M around. Giving the benefit of the doubt. (Plus, there's just somethin' about this story that doesn't ring true. Not sure what it is.)

And frankly, whatever she did, a sixteen year old girl got her wrist broken by a full grown man. I got news...if that happened to my daughter, my husband and I BOTH would be sitting in jail and there wouldn't be any question about whether or not we had battered the 'security' guard.

Even if she did something wrong enough to need to be thrown down over that table like that, breaking her wrist is not called for. It's like the woman that went nuts in the airport and Andrew Meyers...even if they deserved to be detained, they don't deserve to be injured.

or not? According to the above photo excessive force was obviously used by an overweight thug. If nothing was broken, it was only by the grace of God.

But, it would seem to me a bit difficult to fake a broken anything, when we know the "authorities" will contact the Doctor/Hospital involved.
I could be wrong, but somehow the Mother does not seem so dumb that she would fabricate a story about her child's broken arm when it could be so easily verified.

What have the witness statements been?

Did she not comply with his request to put her arms behind her back?

Did she pull forward when he went to put her arms behind her back? Or did someone fall on her? Or did the guard do it...intentionally, even?

Is there videotape of the events leading up to the girl's arrest?

Who were the other teens involved in the altercation?

When was the mother called? When did she arrive at the school? Did her mother go to the hospital first, and then go to the school?

When were the police called?

What does the police report say?

Why did the police arrest the mother?

Did the guard really follow the girl around and hound her to clean up the cake...which she did three times, not to the guard's satisfaction?

Has the guard been warned or in trouble before?

Why was a security guard in the school lunchroom?

What is the guard's version?

Is there video from a security camera? Does it have audio?

Instead of asking questions, so many seem to have just taken the girl and her mother's version of events as fact. There is usually more than one side to a story, I have found...and the truth is somewhere inbetween those two sides. Just sayin'. If it were you being accused, you'd at least want people to wait to judge you until all the facts were in, right? Of course you would.

Somehow I can't figure how that relates to an incident with a room full of witnesses and video of the incident. Not that it even remotely resembles what's been going on in so many recent cases either.

First of all, we *need* policemen because by our all-too-human nature there are thieves, murderers, drunken assholes, and the like amongst us. But if cops wouldn't let their extra privileges and power of authority go to their heads, they wouldn't have to try at all to get our respect. But far too many are cops because they like the power, they like to drive fast, they enjoy intimidating people. They get lost in their world because all they do is look for trouble and then they see it everywhere. They confuse fear for respect and make justifications for the deserved resentment they get in return. There are the those who understand their calling and they do deserve the utmost respect for what they do and how they do it. They truly can be called "Peace Officers" because they understand their role and honestly care about justice. And it's never easy because of the constant expectation of being in control, being ready for anything. Not many job requirements include wearing a bullet-proof vest everyday. That says a lot. I wonder what they think when they are called into riot duty because of a "peace demonstration".

Interesting quote - "The problem with the world is that the stupid are cocksure and the intelligent are full of doubt." My experience around policemen (and I've never been arrested but have worked for a former DA investigator for years) is that the job description tends to attract the former more than the latter. Stupid doesn't mean you can't understand a lot of things, just that one's judgment is impaired by emotional fits and an overly sensitive sense of pride.

But as for the school incident, don't worry, the authorities will investigate what happened and will tell us all the truth so we can sleep well. Good night!

This guy is not a police officer. His shirt says SECURITY on the back. Most of these guys are wanna-be cops who could not pass the background check or psychological exam, etc. That's been my experience with private security personnel a least.

I've been in education all my career and undoubtedly we educators take a lot of unwarranted crap but this is incredible. The school district should have fired that "security" guard immediately. And what was the teen suspended for? Assaulting an officer? Please. My school district has police on campus, not rent-a-cops, but if this guy is from the PD he needs to be, at the very least, placed in leave while an internal investigation is completed. How disgusting is this? I'm speechless.

Then taking retaliatory action against the mother by firing her from her state job for protecting the violent treatment of her 16 year old daughter can be viewed in no other way but thuggery. What is next, lethal force without cause and the herding together of population groups for confinement in concentration camps and gulags?

172. This is not new, but becoming more egregious with every minute.
Twenty years ago, I sent my teenage daughter to school with a stiff neck. Then a friend called with a daughter in the same high school, saying several students at the school had meningitis, and one had died. I flew to the school to retrieve my daughter and take her to a doctor. I had to practically push my way past the security guard, although I'd called ahead.

The nurse's office explained to me that it was *their call* whether a student needed medical care. I don't recall what I said, but I got my daughter and left. On the way out, we were both subject to a smirk and foul language from the security guard.

I didn't report it, I just took my daughter to the doctor. I was guilty of the same kind of fatigue and feelings of not wanting to consort with low beings that keeps so many people from filing complaints.

My daughter didn't have a skin color that inspired the guard to refer to her as a "nappy head." That falls under the rubric of misbehavior of a *hate* variety, and the man should be relieved of any opportunity to ever again serve in a "police" capacity. Further, he should spend the rest of his days making financial amends to that young woman and her mother.

Even if she had misbehaved, which she apparently didn't do, he signed on as an adult member of the school's security group, and should be required to behave as an adult, and to respect the civil rights of *all* the students he comes in contact with.

The thugs come out of the walls. They're everywhere. They are *not* worthy of even sharing the same planet with honest and dedicated law enforcement officers. There are some -- many!!!

We CERTAINLY won't get that kind of talk from the nation's top cop in Washington, it might as well be the governors.

Little more info:

-It wasn't "dropped cake"; it seems students had started throwing pieces of the cake around the lunch room. (this from abcnews)

-The security guard in question is currently on administrative leave; the matter is under investigation.

-The kid filming with the cell phone "also ended up in a scuffle with the security guard, according to his mother..." He was also already on probation for a separate incident, and "...it was not the first time (he) had been in an altercation with that security guard..."

-The other female who was arrested (not the one whose wrist was broken) was the camera-phone-guy's sister, who "...also tussled with the guard to help her brother, (their) mother said."

Cop/security guard making racist remarks? Never okay. Handling a non-threatening, sober, unarmed "suspect" so roughly during cuffing that her wrist is broken? Never okay.

"Scuffling" and "tussling" with the security guard? Not okay.

I have yet to find unedited film of this incident. What I have seen gives me the impression that camera-phone-guy was getting in the guards' faces, almost taunting them. He could have filmed the incident just fine without getting in anyone's face.

These guys don't look uniformed to me, and there constantly referred to as "guards"; if this were an LAUSD school with LAPD security, they'd be called "cops" by the L.A. press. I had to deal with wannabe-LAPD high school security guards when I taught high school in Los Angeles; they suck at their jobs, causing more conflicts than they resolve. When there IS a problem, they tend to aggravate the situation, throwing gas on the fire, resulting in escalation. They have no clue as to how to DEFUSE a situation!

Camera-phone-guy and his sister seemed to be stirring up shit, getting physical with security when the original incident didn't even involve them. They saw a conflict/problem and went jumping right in to get part of the action. No sympathy there. Film as you please, since it could help stop injustice, but back off and butt out while you do it--don't go making matters worse. Ask for a reaction and you'll get a reaction.

As for the guard in question? (Proven) racist slurs? Away with him. His actions alone broke her wrist? See ya--and oh, pay the medical bills and damages too, asshole.

The two other kids? Got what was coming. Look for trouble (they did), you'll get trouble.

The girl whose wrist was broken, whose behavior supposedly warranted her arrest and yadda yadda? I have no idea. I want to see the unedited film and read/hear other accounts before I judge. I'm already not impressed by this "guard", but I still want to know more.

For all those bashing cops in this thread, these guys weren't cops. And no teachers were involved, either.

And no, you cannot just storm into a school and demand that a security guard be fired and expect it to happen. There's a thing called "due process", and this guard is entitled to it.

Seems too many people on DU are all-too-ready to assume the absolute worst about teachers and cops, though you'd be up shit creek without us. We expect to be scrutinized by the public we work for, but we expect and deserve to be evaluated FAIRLY.

for your thoughtful Post. I agree that, rather than jumping on what I call the "burn the witches!" bandwagon, it's much better to find out as much info as possible before judging the situation. A violent group think attitude without proper information can only lead to embarrassing "whoopsies" and "oh shit, I didn't know that"s when it's all said and done.

I live in NYC and, so far, the cops I've met have been pretty cool. Not that EVERY cop -- or person in an authority position -- is cool or perfect, but, then again, not everyone on DU is cool and perfect either.

I've seen a lot of cops who are "cool" go ballistic and completely overreact when they are pissed off. I've seen otherwise very professional highway patrolmen crack a guy's skull when he was already down rather than let him continue to cuss at them.

Authoritarians are generally pretty nice to you so long as you do exactly what they say and give them their due. It's how the guy reacts when he gets some "attitude" from someone or some "disobedience" that's the acid test.

That's when you see the difference between a professional and a thug. I imagine that this girl didn't show this thug what he thought was the proper amount of "respect"; so she winds up with a busted wrist and goes to jail.

99% of the time that would be the end of it.

1% of the time we get a video, and there are people who will defend the thugs to their last breath, even when there's a video tape.

People forget that the first Rodney King jury found the cops "not guilty".

that the Poster I was responding to was making is that you can't just lump all Cops into one big group and call them evil or bad. One also can't deny the fact that there may be information about the people involved leading up to what was recorded on the cell phone that we don't know about. It's very easy to say "the Cop overreacted and he's a horrible person", but I wasn't there so I don't know what emotions were leading up to the confrontation.

I'm not supporting him, by any means. I'm just not the type of person to jump to conclusions and scream "authority = bad", that's all.

245. I can jump to conclusions when I hear racial slurs,
and I see two 16yr old girls with broken arms/wrists. Arms that were broken by big burly cops who said they felt threatened.
Authority is bad when a cop admits he had to control a 16 year old girl which resulted in a fractured arm.

I have a 17yr old athletic daughter. I know she would try to break away from anyone who attacked her, uniformed or not. Her natural reaction to an attack would be called assault, battery and resisting arrest. This could have been my child.

Imo, common sense would suggest that the authority of security guards should be restricted to just that - guarding against acts of violence against the person, and significant damage to property, i.e. vandalism (which latter would not comprise causing food to be found on the floor); Any other disturbing misbehaviour to be reported to the headmaster/mistress or senior teacher present. Otherwise, they should not have authority to tell the children what to do. If he thinks it needs to be dealt with, then he should report it.

Official police work IS different from virtually any other activity in that recalcitrant and violent people are usually only likely to respond to a heavy and menacing police presence, so the relatively few sociopaths among police will exploit the resultant authority invested in them, to the detriment of law-abiding people they consider vulnerable, to sate their own lust for power and self-aggrandisement.

On a course on overseas trade I once attended, I met a lad who worked as a bouncer in the evenings at one of the dance halls of a big chain. They had a scam going on from before his time, whereby they helped themselves to a little of the takings. One of their number apparently split on them, so that one night about fifty police descended on the place in extremely aggressive mode, separated them, put them in cells, stripped them naked and interrogated them. He was quite shocked by the level of aggression of their manner. No physical violence, as far as I'm aware. But thinking about it later, the police couldn't really have gone up to a group of bouncers and told them in very reasonable, measured tones that they wanted to interrogate them, could they?

He was a very intelligent lad, so he'd have thought of that when the dust had settled. Apparently, they wanted to pay for the bloke who told on them to be murdered, and he asked my opinion. I told him to just stay out of it. He was worried about the court appearance he was to make, but I told him he seemed one of the few people I'd met whose employability was unlikely to be unduly adversely affected by having that on his record. He'd been privately educated via a scholarship he'd won, then became a naval officer in the merchant marine, and subsequently worked at a host of other jobs.

He'd come in an hour or two before the rest of us, after a night of debauchery and drugs, and dashed off the homework we'd been given the day before. Then get top marks! I used to feign outrage, of course, volubly cursing the cruelly unfair fate that had ordained this! A bit like the Prodigal Sons' brother... hearing music and laughter in the distance....!

223. It's now a crine to demand the firing of someone who has
harmed your child. The Mother spent a night in jail and it seems that she lost her job for the crime of demanding justice.

So, students were throwing cake, but only one student was expected to be the designated janitor. She refused to follow orders which resulted in a racial slur and a broken wrist. That'll teach her and her uppity Mama too.

I'm certain that the other girl learned a valuable lesson about coming to the defense of her brother. She will not have the nerve to make a mistake like that again, by golly.

You can't tell me these type of events don't happen in White schools. Kids are kids. But it's become almost a given that when you read one of these stories, the kid is Black and his or her life now becomes burdened by a criminal record.

To paraphrase a old saying "When a Black kid takes drugs, it's a criminal act. When a White kid does it, it's a medical problem"

276. They is no "benefit of the doubt" here. The school district's actions scream "guilt" and "cover up"
I am from the South where this kind of crap happens all the time. You guys just don't see this enough to recognize it, I think, so some of you are trying to cut the school district and the security guard some slack thinking "They can't possibly be this bad". The answer is "Yes" they can be this bad.

The video taker and his sister were arrested in order to silence them (they are witnesses with evidence).

The mother was arrested and thrown out of her job in order to deter her from filing a lawsuit.

The girl had her arm broken, because the guard is a sick, racist SOB who gets his jollies beating women and Blacks and children--in front of a crowd if possible to show off his power.

I can't wait for the crowds of protesters who were in Jena to descend upon this shitty little California community to show the world that you do not have to live south of the Mason-Dixon line to be a red neck. California is full of them, too. It is one of the state's nasty little secrets.

283. where, when,? This crap has got to STOP NOW. A grand mother is let off her job for showing her grand
daughter what it is like to have a rope around her neck during a school demonstration, BUT THIS SOB ????
What is HE trying to teach?
Both these actions happened on school property.

While I agree this(the action with the grand mother) would be traumatic for a young grade school student to see and certainly to feel, it is hardly the most dramatic thing a black adult has had to do in order to protect their young from the oppressive and at times murderous inclinations of their captives. It is a national historic fact and shame that older generations of black Americans have had to whip or in other ways punish their young in an attempt to teach them survival techniques in this our "home of the free and the brave."

This is the shame of the NATION not of the parents trying to protect the lives of their children.

After the Jena 6 trial a grandmother trying to show the horror of "the rope" to the youngsters in her group may have seemed like an educational defense against future attacks.

With this video we see her concerns were well founded even if her tactics were not educationally and psychologically wise.

281. local newspaper names thug: CHRIS NIEMEYER
PALMDALE - A community meeting to discuss a Sept. 18 Knight High School melee that ended with the arrest of three students and one parent drew a crowd of about 80 parents, mostly black, who vented their anger over school and law enforcement handling of young people of color.

Over nearly three hours Monday in the Knight High theater, parents and others decried the treatment of the three arrested students, and a number called for the firing or arrest of school security guard Chris Niemeyer, alleging he inflicted injury by way of excessive force.

School and district officials, meanwhile, said the situation is being investigated and Niemeyer will remain on paid administrative leave until the investigation is closed.

"There's due process," said David Vierra, superintendent of the Antelope Valley Union High School District. "We're not going to predetermine what we think that's going to be."
