Every action you take in life COULD affect me, which makes it something I can legislate and punish |

If you use condoms, you are adding to landfills with their packaging and such. If you eat meat, well that is adding to global warming and will affect me. If you have a child, or more than one, you are adding to the population of the earth and spreading consumerism to yet another generation.
If you wear clothes and buy them, well you are either supporting slave labor or you are buying American and adding funds to the war via taxes. If you smoke...well, enough said. If you are eating anything from a food joint with a name I know you are adding to the sickness (heart disease/et al) which is driving up my health care costs. If you are eating anything other than a grown food from your own back yard you are helping to destroy the earth - and hence affecting me.
If you have any children, then you are adding to the burden of the world - and thus affecting me and you should pay. If you buy anything at all, from gas to toys/etc and pay tax on those items, you are paying for the war in Iraq - and hence are supporting killing people.
Everything you do has some affect on me, so I say - legislate and punish you. Fines and jail time might wake you up to the horrors you are causing. You have a choice in life, and yet you continue to flaunt those choices and inflict damage to me and others.
Freedom for YOU ends where my life begins, and if anything you do infringes on that you need to be fined and/or jailed.

it's whether or not the govt has a "compelling interest" that overrides an individual's rights.
When it comes to substances that are ingested into our body, there is a long tradition of ceding to our govt the power to regulate.

That's why John Stuart Mill clearly delineated acts in his famous treatise, "On Liberty", that directly affect others and acts that have a merely contingent effect on others... The former may be legislated against and the latter never...
