Friend of TPM and former Nixon White House Counsel John Dean knows a few things about lawless presidents. He just sent us his thoughts on the now certain confirmation of Judge Mukasey ...

As the Senate Democrats complete another sad concession to President Bush, and confirms a nominee who refuses to declare “water-boarding” torture, allow me to offer a brief historical reminder: the Senate Judiciary Committee has conspicuously forgotten that there are direct situational and historical parallels with Judge Mukasey’s nomination to be Attorney General and that of President Richard Nixon nominating Elliot Richardson to be Attorney General during Watergate.

Nixon’s Attorney General had been removed (and was later prosecuted for lying to Congress) – a situation not unlike Alberto Gonzales’s leaving the job under such a cloud. Nixon was under deep suspicion of covering up the true facts relating to the bungled break-in at the Democratic National Committee headquarters at the Watergate, not to mention widespread rumors that he had engaged in abuses of power and corrupt campaign practices. Today, Bush is under even deeper suspicion for activities far more serious than anything Nixon engaged in for there is evidence Bush has abused the laws of war, violated treaties, and ordered (or approved) the use of torture and political renditions, which are war crimes.

Before the Democrats on the Senate Judiciary Committee completely cave-in to Bush, at minimum they should demand that Judge Mukasey appoint a special prosecutor to investigate if war crimes have been committed. If Mukasey refuses he should be rejected. This, indeed, should be a pre-condition to anyone filling the post of Attorney General under Bush.

If the Democrats in the Senate refuse to demand any such requirement, it will be act that should send chills down the spine of every thinking American.

Call & write.

Don't stop until the very last moment. I won't just keep quiet. I already have written numerous e-mails, & I will be
calling on Monday & spending the day e-mailing & calling friends to try & convince them to do the right thing.

Everyone here should do all they can to stop this insanity!

27. I will call both of them
on Monday....and fill their emails over the weekend.

We have to get a Special Prosecutor. * must have threatened the annihilation of their grandchildren to get them to act in this fashion.

12. I respect John Dean also, geez, this is disgusting.
if Mukasey said waterboarding was torture, we could of got Cheney and * for war crimes. Mukasey was probably being coached by Addington and Cheney, I wouldn't put anything pass these thugs. How sickening.

8. It means Mukasy is the next AG.
it means certain forms of torture are ok (with some Dems too), Bushler and Cheney will not be investigated, and no one will stop the coming war with Iran.

29. I've thought about this ...seems to be "COMPROMISE' and they don't HEAR US..
out there on the internets. THEY don't realize the BIG MO' behind the Dean Candidacy...and ...they see the INTERNET DEMS as a THREAT! So...if they get rid of the INTERNET DISRUPTORS...by doing RESOLUTIONS..Trashing Them...then they can get 'back to business as usual.'

I wish i didn't see things like this, after thinking..but it seems to be what it is.

I had such "HIGH HOPES" when our Dems FINALLY GOT ELECTED FOR CHANGE.... but I think the "change" got scrapped from the agenda...:-(

If you call Schumer or Feinstein, I'd recommend that you request in the most sincere voice that they be the first to stand up and be subjected to a water-boarding treatment to provide evidence that it is not torture. I am confident that if any congressling were to take this experience upon himself or herself that minds would be changed and Mukasey would not stand a rat's ass chance of being confirmed without standing firm on denouncing torture.
