He's to appoint Michael Barutti (sp) as Head of the Consumer Products Safety Cmmission.
EXCEPT this guy used to be the head of the National Assoc. of Manufacturers!
Yet another fox guarding the hen house!
Iheard this on Lynn Cullen's show, so I had to guess at the spelling of his name!

And I'm serious. Complaints should be sent directly to Bush. If he wants to PROMISE no more opportunistic recess appointments, then Congress can once again go ahead and recess. Otherwise, no. Not even through Christmas.

I doubt it.
I don't think a 1-day recess has been used for a recess appointment since Theodore Roosevelt. In more modern times, the Justice Department has opined that a 3-day minimum recess would be required. In either case, making a recess appointment during such a short recess would be VERY politically unpopular, and the Senate is unlikely to respond well to it.
Congress does have the power to stop payment for a recess appointment, and I suspect they would do so in a case like this which would be seen as a pure slap to Congress.
It's certainly possible, but it just strikes me as unlikely.

I just did a little googling, and learned that the board normally has three members. It's had two members since last July, and by law, the commission can only operate for 6 months without three members, so last month was the deadline to fill the last spot. Currently, the commission can't fulfill much of its charter.
So maybe he is using a recess appointment - but I hope that the congress refuses to pay him.
Edit: his name is Michael Baroody, and he was the Vice-President of the National Association of Manufacturers. I can't find any mention of him being appointed today, though.

In a game of insider/Bush donor musical chairs, Michael Baroody, chief lobbyist for the National Association of Manufacturers, a powerful trade group that opposes aggressive product safety regulation, is President Bush's choice to HEAD the Consumer Product Safety Commission. Bush is expected to make a "recess appointment", i.e, where the appointment will not be subject to Congressional hearings/approval."

The job's not fun anymore. Everyone hates him. There's a clear majority right now that wishes the Bush presidency was over right now.
He can't resign because his political benefactors haven't finished the job of making America worse than Benin.
He can't jump off the roof of the White House because Jeebus says you can't get into heaven if you kill yourself.
The only thing he's got left is impeachment. So he's doing everything in his power to get his ass thrown out of office.
Couple the "figure out some way to bypass Congress on everything" story we had up here a couple days ago with Bush's considering a one-day break to be a good time to make a recess appointment, and it's fairly obvious: this is a call for help, and the help Bush seeks most is a plane ticket back to Connecticut where he belongs and the phone number of a moving company.
