Conn. Student Sues After Being Awakened In Class By Teacher Who Made A Loud Noise

DANBURY, Conn., Mar. 13, 2008

(AP) Danbury officials have been notified they are being sued by a student who was awakened in class by a teacher who made a loud noise. Documents filed with the Town Clerk, a prelude to a lawsuit, claim that a sleeping student suffered hearing damage when his teacher woke him up by slamming her hand down on the boy's desk in December.

Attorney Alan Barry says 15-year-old Vinicios Robacher suffered pain and "very severe injuries to his left eardrum" when teacher Melissa Nadeau abruptly slammed the palm of her hand on his desk on Dec. 4.

A city official says the matter has been referred to Danbury's insurance carrier.

1. Yikes
I'm lucky that hasn't happened to me. I don't make loud noises, but once I told a student to wake up his neighbor, and he whacked the guy upside the head (they were friends). I felt bad for that.

Hearing damage my ass. Maybe if she'd slapped him on the ear it might have caused damage. Please put me on that jury.

7. I don't buy it.
There is no way a hand slap on the desk could produce damaging sound. On the top of a metal table, possibly, but not a standard student's desk.

8. Egad, I've done the same to students.
Though my favored method involves slapping the table with a book. Books cause a deeper, more gratifying boom.

I've pissed off a few students over the years, but nobody has accused me of injury. Yet.

11. If the student had the side of his head, and thus his ear...
resting directly on the desk, and the desk was slammed hard by the teacher's hand...I can envision this being enough to break an eardrum.

12. I had a TA back in the day
...who did a classroom version of the "Hey, Tom's asleep on the bus, on '3' everyone scream like we're crashing" trick on a guy who had nodded off. About made everything else about college worthwhile. :)

14. that's ok....I sued
the school board when a student shoved me into a door and caused me a torn rotator cuff and permanent brain injury....the kid never even got detention and she was a 10 year old girl....
