Man sues over neutral feedback left for him on eBay
I didn't see this anywhere on DU but thought I'd share. To me this is sort of the crazy example that some RWer will try to use to claim frivilous lawsuits even though most lawsuits are keeping companies in check from scamming or harming their customers.

Even so it's difficult to imagine anybody wanting to buy from this guy again...

ps - the important part:

"We took the lawsuit to University of Washington law professor Jane Winn.

"I thought that seller was a few cards short of a deck," she said.

The judge in Buncome County, North Carolina might not agree with that assessment, but he recently tossed out the suit. "

This part though is incorrect

Since eBay rules prevented the seller from leaving Shellhorn negative feedback, he dropped the lawsuit against him.


Those rules haven't taken effect yet. You can easily leave negative feedback now.

8. I left a POSITIVE feedback and got flayed!
I bought a small item - a heat pump thermostat - from some guy on eBay. Didn't send instructions, only a listing on a web site that was of no help. Well, I had to buy a $50 thermostat that would work. But I wasn't going to ask for my money back or anything. I took a chance and payed $15 (with shipping) for the thermostat. So I gave him positive feedback and added the comment, "Didn't get instructions. But it arrived okay."

This guy screamed "Take back your F***ing LIES or I'll give you negative feedback!"

I explained it to him again. He still claimed I was a liar and if I didn't bend over, kiss his tuchus and humiliate myself, I would get negative feedback.

Well, I took the negative feedback. One negative versus the 450 positives I got. My feedback commentary: "You can't please everyone." The guy is continuing to send e-mails. I told him that he has a psychological problem and he had better seek help.

So nothing surprises me about some idiot taking offense. I expect to see this guy picketing my front yard in dirty underwear and house slippers with a sign saying "LIAR!"

11. I agree
My brother sold a lot on ebey and most people use the feedback system to help people locate bad buyer/sellers. Most people go out of their way to get the transaction correct. But their is a small insane branch that feel the feedback system is somehow set up to exact revenge on people for imaginary infractions. The system should be fix to see a persons feedback ratio. I.E. is the negative feedback from a person that leaves only negative feedback. Right now it's hard to see advice from people but very hard to see how useful that advice is.

12. Buyer Beware
I had a go-round myself with one of them. And at "the end of the day," the only thing I could be satisfied with was that he was the only seller who ever gave me retaliatory negative feedback for stating the truth about him and how he operates. Stands out like a sore thumb in my rep.

... Ebay doesn't let sellers leave feedback any more, they abused it by giving negative feedback to any buyer who dared to give it to them.
