As you said, the petitioner is the person who is disputing the lower court ruling, which can be either the plaintiff or the defendant (or the applicant or respondent, etc., from the lower court decision).

The son of a friend of mine was once studying in Chicago. His landlord was none other than one Antonin Scalia. When the time came for the young man to move on, he told his landlord that he would not be renewing his rental contract, and requested the return of the money he had left with Scalia as a security deposit. Scalia refused to return the money. Only after making a credible threat of legal action did Scalia finally return his security deposit. Apparently, Scalia had a hard time getting over his legal obligation to return money that wasn't his.
