BARNSTABLE — Four anti-war demonstrators facing trespassing charges in connection with a sit-in at U.S. Rep. William Delahunt's Hyannis office last month were disappointed when the district attorney's office opted not to prosecute the case yesterday.

"That pulls the rug right out from under us," said Paul Rifkin of Cotuit.

Rifkin and co-defendants Diane Turco of Harwich, Sarah Thacher of East Dennis and Michael Risch of Falmouth had hoped to take the case to trial to highlight what they believe is illegal and immoral congressional funding of the war.

"It's theater at this point," said Rifkin, owner of Moonakis Cafe in Falmouth. "We need to inspire people to come out (and join peace demonstrations)."

Turco said the four demonstrators were hoping for a jury trial so they could "be judged by our peers."
