(Legal Question) CAN WE SUE T. Boone Pickens????

Pickens is the Texas oil tycoon and major Swift Boat Veterans for Truth financier.

Ten veterans who witnessed or served with John Kerry in Vietnam penned a lengthy letter to T. Boone Pickens because he bragged in 07 that he would give a million bucks to anyone who could show that anything SBVT said was false. They want to claim the million buck.

OF COURSE this is all 4 years too late. But it still pisses me off when I read about it.

Does anyone else think that average American Citizens could file a lawsuit against Pickens for Slander of Kerry which led to the second term for GWB which led to the death of thousands of Americans and the fall of our economy???? I would be willing to start it.

Any Thoughts????

1. I just read this article and I wondered about something
the article quoted his spokesperson as saying, "He is not giving anything to 527s involved in the presidential race this cycle, and has communicated that...to Republican strategists and operatives."

My question is this: Isn't it illegal for the RNC or the McCain Campaign to have any contact or discussions with or about 527s?

3. They don't even try to hide their criminality anymore
Fuck, even Nixon's crew tried to launder their illegal campaign contributions through a Mexican bank. These guys don't give a shit what we think, they've got the Justice Dept. on their side and we can just go fuck ourselves.

6. you're right....
they have run this country as a corporate backed dictatorship for 8 years.
I just hope we're able to turn it around in my lifetime. for my kids' sakes.

4. Tough case
You'd have to prove something Pickens said was false and then you'd have to prove he said it with actual malice, meaning the statement was made with reckless disregard for the truth. Then your average American citizen would have to be damaged and a court these days would probably say damages were too speculative or too remote.

5. crap....I know I've seen more
frivolous law suits, but I guess you're right. Although Bush has damaged America, my country. that would be easy to prove. and Pickens had a big hand in getting him elected.

the ten veterans who served with Kerry did an excellent job of disputing his claims, since those would be eye-witness reports I'd have no doubt we could prove most of his claims false. That could lead to the fact that he had a reckless disregard for the truth FOR political gain--which that would have to be the only motivation.

I do wish it could be done---that would be one way to keep the swift boating from happening again, as we all know it will.

it just doesn't seem to be the American way to let those bastards get away with the lies that changed the standing of our country.

7. Times v. Sullivan is good law...
...and a good law. We stand to lose far more than we gain if its reach were diminished, as Justice Scalia and others would like to see.
