he is in his 70s , is overweight and drinks and smokes a lot. he eats a lot of bad food also.
i think along with Stevens and Ginsberg who will probably retire, Scalia may leave for health reasons . the next President will have the power to appoint at least 3 justices.

Look what having Alito taking Sandra Day O'Conner's place did. And Souter was nominated by a republican, I think by Poppy. However, he is somebody who respects the constitution and doesn't try to legislate from the bench.

I don't even care if they aren't flaming liberals, I just want them to respect the constitution. There are a lot of 5-4 decisions going either way, mostly on the controversial things. And Kennedy is always the swing vote. So you could have many 5-4 decisions go to either 6-3 or 5-4 the other way. So it could have a big impact.

No way he'll retire. Many are amazed to know this goon has been on the court now for over 20 years and for many years was touted as the next Chief Justice. He became so toxic in the court and inside this regime that when the time came he got passed over. I've noticed since that time he's really gone off the rails. It's as if he can be "free" to be the asshole he always was and now with his buddies Roberts, Alito and Thomas next to him, he's like the gang leader of their own little club. Big Tony's "the man"...he doesn't just control his vote, but three others on that court. Why quit now?
While I expect the next Supreme Court vacancies to be from our side...Stevens is nearly 90, Ruth Bader Ginsburg has health problems and I've also heard that Breyer has hinted he'd like to do something else. However, looking at the Scalia gang, there's some reason for health concerns there as well...Roberts already has had a seizure, Thomas keeps looking fatter and older every time I see him and Big Tony's gotta be a walking cholesterol ball. Not that I'm hoping for any misfortune...I'd prefer Big Tony wakes up some day and just ups and quits, but I suspect he'll wait til the bitter end...and I do mean bitter.

will retire, but if he did, it would be right now, right after this court session ends, so that W can nominate another justice on the lines of Alito or Roberts to replace him. I agree that Stevens and Ginsberg are hanging on until a Democratic president (please dear Gods as of January, 2009!) takes office. But Tony - nah, he thinks he's invincible and will live forever, or at least until there's another Republican president in office to nominate his successor.
