Was There A Constitutional Convention Today? Did I Miss It? |

All afternoon I've been hearing tell of how the fourth amendment was dead, that it was, somehow struck down today by a vote of the Senate.
Sorry. No, it's not quite that easy. The only way to change the Constitution is with a Constitutional Convention.
Yes amendments can be added or rescinded by Congress, but only with the ratification of the states. That didn't happen.
The next time you get busted for a few joints by some ambitious policeman and he didn't play by the rules. Providing you have a good lawyer and an honest judge the Fourth Amendment will still prevent you from being convicted.
What happened today is that our elected crony capitalists pulled a scam to let their crony capitalist friends who run telecom companies off the hook for spying for an unelected junta. And, Yes I'm pissed off about it too.
But it's gonna take a lot more process than that to kill the Fourth Amendment.

Our Congress cannot pass legislation that ignores the Constitution therefore what they did is ILLEGAL and every one of them should be held accountable. It is a failure to uphold our constitution and treason. Our Fourth Amendment is the law, this legislation is illegal.

No matter how traitorous they are, we can't lose the majority; that is far more important than any piddly little scrap of old paper. So suck it up and keep those Democratic Senators in office, there's a good little half-witted sheep.

The leadership has chosen to ignore the Constitution. If the citizens role over and play dead, while thinking God that their all knowing, all wise, all loving leadership are willing to protect them, no matter what the cost to the Constitution, then the Constitution is dead.

It wouldn't be the first time it was done. The number is not set by the Constitution.
It would sure be nice for Obama to appoint 6 new, young, LIBERAL justices next year. And maybe some of our older liberal justices would want to retire so he can appoint even more.
It could shift the court way to the left for a long long time.

You'd need 60 bullet proof votes in the Senate to do that, and I don't see it happening.
FDR couldn't do it, and I doubt Obama could, even if he wanted to do it.

A Constitution is only of the slightest importance so long as it is being followed. If it is not followed it is injured. If it is ignored it ails and sickens. If it is violated in wholesale fashion, for years in secrecy and for years more in broad daylight, and if the trespasser is not held to account but absolved instead and his crimes declared all legal, then the Constitution is dead, buried and forgotten. You don't need a Convention for it, you need a Remembrance Society.
In lieu of flowers, the bereaved suggest you save your money for a run to the border.
