(X-post) What was the reaction of the RW to the Gulf War POWs who wanted

to sue Iraq? (And ** and the SCOTUS said no, I think?)

Anyone remember what the pundits and FR said, and whether or not they attacked the men themselves?

1. I found this

"But money from Iraqi assets has been transferred to a federal reserve bank, and L. Paul Bremer, the chief U.S. administrator in Iraq, has told the court he needs the money to rebuild the country. Justice Department attorneys have argued that because Saddam Hussein has been ousted, Iraq is immune from such lawsuits."

"“We are mindful of the gravity of (the POWs’) allegations in this case. That appellees endured this suffering while acting in service to their country is all the more sobering,” Judge Harry Edwards stated in the opinion.

“Nevertheless, we cannot ignore ... its impact on the United States’ conduct of foreign policy where the law is indisputably clear that appellees were not legally entitled.”

Judge John Roberts filed a separate concurring opinion."

Judge John Roberts, sound familiar?

"They also argued that the POWs weren’t entitled to the money because President Bush made an official determination in May 2003 that a statute allowing payment from frozen assets wasn’t applicable to Iraq because it no longer supported terrorism after Saddam was overthrown.

In his concurring opinion, Roberts agreed. Denying Bush’s authority to make these determinations and having them apply retroactively could unfairly force new regimes like those in Iraq to pay for the wrongs of the previous ones, he said."

There you go, the Bush Administration supporting the troops as usual!!!!

6 May 2005

"The US Supreme Court decided last week not to accept an appeal from a group of American soldiers who had won a lawsuit against the regime of Saddam Hussein, charging they were tortured while held prisoner during the 1991 Persian Gulf War. The court action, taken at the urging of the Bush administration, overturns an award of $959 million in damages."

2. Thanks. Yeah, I was pretty sure ** stiffed them. But I was wondering about
whether or not any of his talking heads shredded these guys over it. If they did, then maybe the "McCain's a POW. Don't talk bad about him" thing can go out the window?

3. I can't find a single comment by any RW site about this. It's as though they never
wrote anything about it.
