Federal Court Rules Against Bush Administration’s Subversion of California’s Medical Marijuana Laws

For the first time, a court has recognized that a concerted effort by the federal government to sabotage state medical marijuana laws violates the U.S. Constitution.

While California’s landmark 1996 medical marijuana law has mostly been upheld by the state’s courts, after the U.S. Supreme Court’s unfavorable ruling in 2005 it appeared the sun may have been setting on medical marijuana reform in the federal courts.

The outlook is a whole lot brighter after last week’s ruling by U.S. District Judge Jeremy Fogel of San Jose, which denies a Bush administration request to dismiss a lawsuit by Santa Cruz city and county officials and the Wo/Men’s Alliance for Medical Marijuana (WAMM), which was raided by federal agents in 2002.

2. Good news! K& R! The U.S. 'war on drugs' is INSANE.
It's gone beyond being just really bad policy, to being an outright, no holds barred war on the poor, on behalf the Big Pharma and police state/'prison industrial complex' war profiteers.

End the war on drugs! Start democracy! And save ourselves trillions of utterly wasted dollars!

3. Plus the lives that would be spared ruination
The worst part about drugs is the illegality of them. By taking that away the profits are gone and so with them so goes the pusherman. Peer pressure without monetary gain would not be as strong as it is now with the potential to make a buck. A lot of people who do drugs couldn't afford them if they couldn't sell some to pay for their habits.

11. Well stated. Funny I never think of big pharma when I think about
mj (duh, huh?). I think that it was put on earth for a reason, that it's a weed and should be available FOR FREE anywhere it happens to sprout up.

5. GREAT news. Should help New Mexico, the first state to propose state-licensed grow operations ...
... so that patients can get immediate (and cost-effective) access to cannabis as soon as they are deemed eligible. I'm heading to Santa Fe to testify on that state's proposed regulations next Monday. If anyone wants to see New Mexico's proposed regulations (and my comments on them), please PM me with your email address and I'll send them to you.

13. Didn't know that about New Mexico...Makes me even sadder that
Richardson couldn't done better with his campaign. He was my second choice (sorry) Kucinich was my first.
