Murder Charge Filed Against 91-Year-Old Man

Murder Charge Filed Against 91-Year-Old Man
TACOMA, Wash. -- Prosecutors have filed a second-degree murder charge against a 91-year-old man accused of fatally shooting a 39-year-old caregiver at a family-run adult care facility.

Investigators said Joe Conway Elder, a resident of the care home, shot Ramoncito Barro at the facility in University Place on Tuesday.

Elder appeared in court Wednesday afternoon and was ordered to Western State Hospital for 15-day evaluation.

Prosecutors said Elder was ruled mentally incapacitated by a King County judge last year with symptoms of delusion, paranoid schizoid behavior and depression.

3. Why not? You get away with murder just because you're OLD? And who let the old bastard
have a fucking GUN in a nursing home in the first place?

THEY need to be prosecuted as well.

He's already been judged mentally incapacitated. Charging a 91 year old who's been officially deemed mentally incompetent, with murder, is not going to fly. For obvious reasons.

12. In Washington State, he can still be charged
with a felony, which will mandate a trial of some sort--either by jury or by a single judge's decision if his defense attorney steers him that way. He will go to the state hospital, with or without the plea of insanity, even if the court's decision is "Not Guilty by Reason of Insanity."
The bigger question is how did he get a gun? There should have been an inventory of his belongings when he checked into the adult family home (a common care setting for elderly persons with mental illness).
