She is going to be 77 years old.

3. They may not do it right away. In fact I think waiting at least a year would be preferable
unless someone is taken ill

It gives time for the administration time focus on immediate problems, i.e. the economy, healthcare, and the Iraq War

Within two years however would be perfect timing


That is unless one of the Federalist society judges retires, that would be good if it occurred ASAP

5. I doubt any of them will retire until the end of this session of the court
This session just started and won't end until June. Someone may announce their retirement in the spring, figuring that a replacement can/will be confirmed before the next session begins.

7. Scalia's getting long in the tooth...
If he retires, that's a big opportunity to bring some badly needed sanity to the SCOTUS.
