I believe Prop 8 will get overturned in the courts
As bad as some aspects of this country may be, to think that we would constitutionally enshrine discrimination seems impossible to me.

No other form of discrimination has stood the test of time and the verdict of the courts.

Easy for me to say .... I have only a moral horse in this race. But this issue matters to me - to my wife and me, actually. We have too many friends and we both have too many professional acquaintances who could be affected by it not to care.

5. Everyone has a "horse" in this race.
For if they can take away someone's rights, based on a majority rule proposition, then they can take away the rights of ANY minority. And, at some level, we are all members of some minority or other.

3. How, pray tell?
Proposition 8 changed the state constitution. The state courts are now OBLIGATED to enforce it; they cannot strike it down. The process of getting it onto the ballot has already been challenged; the courts said that the measure was valid.

The federal courts could intercede, but that would require a ruling that the United States Constitution allows for same-sex marriage, much as the 1967 ruling in Loving v. Virginia held that the US Constitution allows for interracial marriage. Such as ruling is extremely unlikely.

8. It's an amendment to the CA constitution. They took this tack because the
previous proposition about this was mere statute and WAS overturned. You can't take a constitutional amendment to the courts. They did an end run around that.

12. It absolutely sucks that Prop 8 passed, but it will not be forever
The arc of history bends inevitably to justice, however slowly, as Dr. King so wisely observed. This will not be over until the courts weigh in.
