How easily can an new Prop in 2010 over-rule Prop 8? |
|
NBC Nightly news clearly showed a movement towards more acceptance with each election cycle (2000: 30% or so and 45% in this cycle).
Can you create a new Proposition in 2010 that removes Prop 8 from the CA Constitution? Given the voting trends it has a good chance of passing in two more years.
Or does California law not work that way?

in CA, as it has with Prop 8, you must revise the Constitution in order to change changes made by an amendment.
A revision requires a Constitutional convention and 2/3 vote of the State legislature in order to be put to a vote by the electorate.
But first the electorate has to vote on a ballot initiative as to whether or not to call a Constutional convention.

Because it doesn't make sense that an amendment to the Constitution can be challenged on the basis of its constitutionality.

what was called Proposition 4 this cycle a total of THREE times since I moved here in 2006.
Proposition 4 was the parental notification for abortion proposition. It has failed all three times that I have voted against it.
