Can't we just start going after the planners of 9/11 as a criminal case rather than a case for war?

Can't we just start going after the planners of 9/11 as a criminal case rather than a case for war?
If we were to receive information of a location some where we believe some of these people are at and is beyond the scope of our FBI or CIA I would have no problem with a group of our Special Forces being called in to kill or capture them.

But no more wars where we end up getting stuck chasing around ghosts like we are doing now. Not in Iraq. Not in Afghanistan. Not anywhere.
