Ohio's Sec. of State fights to count the vote ... Republican wants no count
Count the vote and we get one more Dem into Congress.


Long Story Short 149 votes is the difference between (D) Mary Jo Kilroy and
(R) Steve Stivers for the House seat in Ohio's 15th district. The Franklin County
BOE made many people vote on Provisional Ballots (35,000) even though Ohio's
Sec. of State Jenny Brunner had made a ruling that many of those people could
vote a regular ballot prior to the election. The Republican has now filed a suit
to get many of those provisionals pitched because the voter did not print their
name on the envolpe even though the voters are registered and legal voters.

Same old story republicans win if all the votes are not counted.

Secretary of State Jennifer Brunner is seeking to move a lawsuit filed Th rsday in the Ohio Supreme Court challenging her rules for counting provisional ballots Brunner filed a motion this morning in federal court to consolidate the state case with a lawsuit already pending before U.S. District Judge Algenon L. Marbley.

"Consolidation is appropriate because these cases present identical legal issues, and necessary in order to avoid the risk of inconsistent legal rulings in the short time remaining for the counting of ballots in the 2008 general election," attorneys for Brunner wrote in the motion.

At issue is a dispute about counting the provisional ballots that could decide the too-close-to call 15th Congressional District race between Republican Steve Stivers and Democrat Mary Jo Kilroy, as well as possibly two close Ohio House races in Franklin County.

Stivers' campaign filed the lawsuit in the Ohio Supreme Court on Thursday, arguing that Brunner is wrongly telling the Franklin County Board of Elections to count what Brunner said "may be hundreds or more" provisional ballots placed in envelopes on which voters did not both print and sign their names as required.

1. Botany, We owe you and your fellow Ohioans a huge
thanks for electing Brunner.
If she weren't in there, it's unlikely we'd even be hearing of such challenges since a different Secretary of State might have taken Blackwell's path and supported every attempt at suppression and purging. She has won previous lawsuits; hope Brunner wins this one, too.

2. She is gonna be on the Supreme Court, in the Senate, or in the White House .
... someday. She is very smart, very good, and a friend too. I can't
tell you how proud I am of her. She has this funny idea about fair, open,
and honest elections.

There are signs that must be prominently posted and we have included instructions on backup paper ballots in poll worker reference guides that will be at polling places.

We're rolling out radio PSAs tomorrow featuring John Glenn that mention the right to request a paper ballot "whenever and wherever you vote, even if your county uses touchscreen machines . . ."

The number of early voters is phenomenal! I love democracy. Have a great night.

Great in the other areas too, but it would be fantastic to have someone so cognizant of election issues on the Supreme Court.

Thanks for sharing that email. Really shows her dedication. And now I'll think of you as Botany XXX :P

I don't know if you know that she was getting death threats
(thanx to punks like Hannity) because people were being
told all that ACORN crap .... right wing radio and T.V. had
the "mouth breathers" thinking that all the early voting
(Her idea .... you can screw w/ one day but not 2 months)
were fakes that were doing it for crack, beer, and $20.00.

Our local paper (right wing shit rag) "The Dispatch" has been
100% nasty to her.

Great pic!

Just terrible that Brunner would be threatened like that. Hope they catch the jerks. And now I will add courageous to the list of her attributes.
