Count the vote and we get one more Dem into Congress.
Long Story Short 149 votes is the difference between (D) Mary Jo Kilroy and
(R) Steve Stivers for the House seat in Ohio's 15th district. The Franklin County
BOE made many people vote on Provisional Ballots (35,000) even though Ohio's
Sec. of State Jenny Brunner had made a ruling that many of those people could
vote a regular ballot prior to the election. The Republican has now filed a suit
to get many of those provisionals pitched because the voter did not print their
name on the envolpe even though the voters are registered and legal voters.
Same old story republicans win if all the votes are not counted.

Secretary of State Jennifer Brunner is seeking to move a lawsuit filed Th rsday in the Ohio Supreme Court challenging her rules for counting provisional ballots Brunner filed a motion this morning in federal court to consolidate the state case with a lawsuit already pending before U.S. District Judge Algenon L. Marbley.
"Consolidation is appropriate because these cases present identical legal issues, and necessary in order to avoid the risk of inconsistent legal rulings in the short time remaining for the counting of ballots in the 2008 general election," attorneys for Brunner wrote in the motion.
At issue is a dispute about counting the provisional ballots that could decide the too-close-to call 15th Congressional District race between Republican Steve Stivers and Democrat Mary Jo Kilroy, as well as possibly two close Ohio House races in Franklin County.
Stivers' campaign filed the lawsuit in the Ohio Supreme Court on Thursday, arguing that Brunner is wrongly telling the Franklin County Board of Elections to count what Brunner said "may be hundreds or more" provisional ballots placed in envelopes on which voters did not both print and sign their names as required.
