Volunteers Needed NOW to Monitor Post-Election Procedures

The Gay/Lesbian/Bisexual/Transgender (GLBT) Community and its supporters nationwide are mourning and organizing in the wake of last week's announced 52-48% passage of Proposition 8, which eliminates the rights of same-sex couples to marry in the state of California. But an accurate count of the votes may not yet have occurred, according to early indications.

The integrity of an election takes time to investigate, and it's far too early to draw conclusions. However, consider the following:

Around the world, exit polls are used to determine the need for investigation of elections. In the U.S., the National Exit Poll (NEP, also known as Edison/Mitofsky) now adjusts results to match vote counts before issuing its final polling numbers. Election Defense Alliance downloaded NEP numbers from the internet on election night, however, before poll results were changed to match the official vote count.

Emlev contacted afer I offered to design fliers, so let's give her a hand with this. If you are in CA and planning to protest this weekend, or even if you are protesting anywhere else, print off a few fliers and hand them out. The flier is designed to be cut in half.

16. Would love to have some of your church members sign up to monitor
We still need more people. Training is tomorrow (Sunday) at 4 p.m. via telephone conference call. If people can't make it at that time, we can make other arrangements to train them.

this is where the law is really screwy, legally did we only have 5 days after the election to ask for a recount.

9. I believe
that it's actually the five days after certification of the election when a recount can be requested.
But we're not yet at the point of recount, as the initial count isn't yet complete.

What we need now is people to observe the processes happening now at county elections offices. Among other things detailed in the article.

ELECTIONS CODE SECTION 15620-15634



15620. Following completion of the official canvass, any voter may,
within five days thereafter, file with the elections official
responsible for conducting an election in the county wherein the
recount is sought a written request for a recount of the votes cast
for candidates for any office, for slates of presidential electors,
or for or against any measure, provided the office, slate, or measure
is not voted on statewide. The request shall specify on behalf of
which candidate, slate of electors, or position on a measure
(affirmative or negative) it is filed.
If an election is conducted in more than one county, the request
for the recount may be filed with the elections official of, and the
recount conducted within, any or all of the affected counties.
For the purposes of this section "completion of the canvass" shall
be presumed to be that time when the elections official signs the
certified statement of the results of the election except that, in
the case of a city election, if a city council canvasses the returns
itself and does not order the elections official to conduct the
canvass as permitted by Section 10263, "completion of the canvass"
shall be presumed to be that time when the governing body declares
the persons elected or the measures approved or defeated.



15621. Following completion of the official canvass, any voter may,
within five days beginning on the 29th day after a statewide
election, file with the Secretary of State a written request for a
recount of the votes cast for candidates for any statewide office or
for or against any measure voted on statewide. The request shall
specify in which county or counties the recount is sought and shall
specify on behalf of which candidate, slate of electors, or position
on a measure (affirmative or negative) it is filed.
The Secretary of State shall forthwith send by registered mail one
copy of the request to the elections official of each county in
which a recount of the votes is sought.
All the other provisions of this article shall apply to recounts
conducted under this section.
