And gosh. . .since marriage is a CIVIL institution, why would anyone think it wasn't a CIVIL RIGHTS issue?

That's right - this must be why we have all of the religious tyrants screaming about controlling the civil contracts of other Americans.

It's because, with the California gay marriage ruling, this is the first time gays and lesbians are considered a suspect class (worthy of minority protection on par with racial minorities and women - and groups such as the NAACP agree with this) and also marriage is now considered a Fundamental Right in California. California has its own equal protection clause and requires, in the case of sexual discrimination, more strict protections than the Federal counterpart. The whole point of these protections is to give the judicial branch power to defend the minority against the majority, or against unfair legislation.

The NAACP and other groups have filed a law suit against Prop 8 arguing: "Petitioners do not come before this Court concerned only for those people of color who identify as lesbian, gay, bisexual or transgender, inportant as they are. We come to the bar of the Court concerned about our entire communities, all of whom would be imperiled by a rule that permits the rights of the minority to be selectively revised at any time by the caprice of the majority."

More CNN viewers would probably agree that this is a civil rights issue if they were aware of these facts.
