State trooper from Grafton suing over Taser injury


Participants in the seminar were invited to have the weapon used on them ‘to better understand the effects of the device upon a human being,’ the suit says.


GRAFTON — A state trooper is suing the makers of the Taser, claiming that an exposure to the electroshock weapon during a seminar in 2006 bent a surgical screw in his leg.

James Foley of Grafton has filed the suit in U.S. District Court in Worcester, seeking $1 million and claiming the injury caused by the Taser incident caused him to experience pain and suffering and a diminution in wages and earning capacity.

According to the suit, the incident also caused what is described in the suit as a “loss of consortium” with his wife, Danielle Foley, who is also named as a plaintiff in the suit.


One of Trooper Foley’s lawyers, Salem-based Jeff Scuteri, said the $1 million is simply a placeholder number, and does not reflect what the actual award might be, should the trooper win at trial. He said the “loss of consortium” is a legal term that refers to a loss of care, comfort, companionship or support.

So many variables when using something like a taser - you would think they would be more hesitant to use them.
