weapons ban) law will hurt the Democratic Party if it passes and he signs it, even Pelosi with her pro gun-control past recognizes that and opposes efforts to renew the AWB. Obama has an opportunity to silence his critics and earn political capital by saying, “I did not fully understand all aspects of efforts to ban semiautomatic firearms with the Assault Weapons Ban. I oppose its renewal and stand by my promise ’I believe in the Second Amendment. I believe in people's lawful right to bear arms. I will not take your shotgun away. I will not take your rifle away. I won't take your handgun away.’”

His response, through Gibbs, should be, "We are considering all efforts to reduce gun crime, but A.G. Holder misspoke when he implied that we were going to revive the Assault Weapons Ban. This administration supports the lawful right to bear arms."

The second amendment says "a well regulated militia". A person is not a well regulated militia.

a assault weapon. An assault rifle is capable of full automatic fire while an assault weapon isn't. A big problem with the old AWB was that it was based more on cosmetics then on actual function. One could kill just as many people just as well with a legal hunting rifle as one could with a banned rifle.

Where SCOTUS confirmed that the second confers an Individual right that does not require membership or participation in a militia?
As far as I'm concerned "that hick"... if he can afford the $18,000 to $25,000 for that M-4 (if he can even find one for sale anymore), passes the extensive FBI background check, pays the $200 tax stamp, waits the normal 6 to 8 month period for a class III weapon, has his fingerprints on file with the FBI and Homeland Security and is romping around on his own property and shooting with a safe backstop is fine with me.
Why would you care what he owns?

It does not say anything about the bearer of said arms being in a militia.

Explosives and automatic weapons are already heavily regulated. What danger do you feel is posed by a firearm that fires one round per trigger pull?
The AWB is legislation written by people who nothing about guns. Most of the banned weapons are banned based on what they look like, rather than any functionality that would make them any more dangerous (or different) than other weapons.
