“We are the ones we’ve been waiting for.”

So of course a guy like Bernie Ellis — who signs his letters with this catchphrase, and who lives it in so many ways, doing what needs to be done, putting himself in the vanguard of vital social movements like the one for fair elections (which is how I know him) — would eventually get nailed for crossing a line.

How easy to have played it safe, but Ellis, who until a year and a half ago lived on a 187-acre farm 40 miles southwest of Nashville, Tenn., and worked as a public health epidemiologist, had been growing, along with other crops, a small amount of medical marijuana on his farm. The recipients over the years, via their social workers, were terminally ill AIDS and cancer patients, who obtained nausea and pain relief from what has been called (by no less than Francis Young, a Drug Enforcement Administration law judge) “one of the safest therapeutically active substances known to man.”

For reasons that will probably forever remain murky, Ellis’ farm was raided in August 2002. A few days earlier, a local dealer had tried to buy some pot from him and was told to shove off, so the suspicion lingers that the dealer turned him in. Two helicopters swooped overhead and eight or nine officers of the Tennessee Marijuana Eradication Task Force entered his property — a lot of hoo-hah, you might think, for seven pounds of weed, worth about $7,000.

Ellis was interrogated for two hours and freely “confessed” to his activities. Indeed, at the very moment of the raid he’d been crafting recommendations, at the request of New Mexico’s then-Gov. Gary Johnson, on how that state could establish a program making cannabis available immediately to patients in need. He gave the officers a printout of his proposal. How guilty can you get?

“I said this from the beginning,” Ellis told me. “I’m not ashamed of what I’m doing.”

And he wasn’t arrested. The Task Force officers did some checking around and learned that Ellis was not only well known but highly respected among county officials. His troubles didn’t begin till the federal government became interested in his case — and this gets at the core outrage of the whole matter. The zeal to keep marijuana criminalized in the face of so much evidence — it has 50 to 100 therapeutically beneficial subcomponents and has been studied in connection with the treatment and control of Alzheimer’s, brain tumors, epilepsy, MS and even schizophrenia, among much else — emanates from the federal level.

Welcome to the Bush administration’s other bogus war: the war on drugs. Science be damned. Rationality, compassion and state’s rights be damned. What matters is the continual drawing of random and arbitrary borders, which are then ruthlessly defended no matter what. And with the drawing of borders comes the creation of enemies, and in the world of herbs, marijuana is the enemy — the devil weed, no matter how medically useful.

As Ellis noted, “Every federal commission since Nixon has recommended reclassifying marijuana, allowing it to re-enter the medical pharmacopoeia.” Yet the feds have been known to prosecute medical marijuana growers even in states that have legalized it. Twelve have done so, including, most recently, New Mexico, whose law, signed last month by Gov. Bill Richardson, incorporates the recommendations Ellis was working on at the time of the raid.

No matter. In federal court, Ellis was prosecuted as an ordinary drug dealer and convicted. Though his sentence was relatively lenient — an 18-month term in a federal halfway house, which ends in May — he has incurred some $70,000 in legal debt and, far more frightening, faces the loss of his farm in a federal civil action.

For my friend Bernie’s sake, I truly hope the forces of rationality are successful. And I recoil at the idea that his beautiful farm, where he has lived for four decades, could be fed into the maw of “example,” a reminder to like-minded others that an ignorant and arrogant administration is in power right now and will impose the Dark Ages on all of us for as long as it can.

6. Yeah, Bernie and I worked out of the same County Dem HQ pre 2004 Election
And were the first two to show up at the county election supervisers office post election
demanding facts and figures. The Nashional Election Reform Conference of April 2005 (the first one)
grew out of that.

Good morning, all you DU-gooders:

As I await release from the federal Bureau of Prisons halfway house in Nashville
on May 10, activities
regarding the feds' continuing effort to confiscate my 190 acre farm are
beginning to heat up. Last
week, Channel 4 (the Nashville NBC affiliate) ran as their 6:00 pm lead a very
positive story on my
case. Here is the direct link to that video for those of you who haven't seen

Shortly thereafter, my attorney contacted me to say that the feds have moved my
civil asset forfeiture
case from the inactive file and are moving to get it on the docket. (Who says
the feds aren't paying
attention.) We are in the process of offering the feds a monetary settlement to
drop the case. There
are several things that are happening to help raise funds for that purpose. An
April 25 benefit will be
held in Nashville, starring a number of very popular local musicians. That
benefit will be broadcast
live (in its entirety) on the Internet at www.radiofreenashville.org (from 7-10
pm Central time). The
Nashville Scene, our award-winning weekly paper, has contacted me about running
an article in the
next week or so. In addition, I have heard from Bob Koehler with the (Chicago)
Tribune Media
Services that he intends to devote an upcoming column to medical marijuana, and
to my case in
particular. I really appreciate all of this support.

Given Bob Koehler's national visibility and how much we DUers think of him, I
am writing all of you to
ask whether any of you would be willing to construct and post a thread on DU (in
a forum or forums
where it will get the most visibility) that will feature Bob's column and also
make a direct appeal for
support from DUers (by sending them to my web-site: www.saveberniesfarm.com ) to
help me settle
this case with the feds. (By copy of this email, I am asking Skinner at DU to
approve this thread ahead
of time.) If any of you would be willing to do that, please email me back and
let me know. I will then
work with you to put the thread together. The rest of you can help immensely by

comments to the thread once it is posted (on the medical marijuana issue, on
civil asset forfeiture, on

Interesting thing about the "war on terror" and how some of the abuses of the "war on terror" or some of the ones that people have been experiencing for a very long time with the "war on drugs."

The fourth amendment was over for us for a long time. Who cared about UNREASONABLE SEARCHES and SEIZURES, as long as it didn't interfere with all of those self righteous "lawmakers" who passed the laws that even went so far as to force "MANDATORY SENTENCES" in which Judges no longer get any say into punishment in some cases.
These are the same republicons who wanted to "get government out of our lives" because the government was soooo intrusive into our homes at that time in our history.

Actually the republicon revolution in 94 the "Contract with America" was really a code for "Contract ON America", because the republicans made sure the government got out of Americans lives, i.e. code for "Out of CORPORATE America's lives."

The war on drugs like ALL War Profiteers takes its share of the money generated by the "war on drugs" it's ALL part of their GAME...

WASHINGTON, Feb. 13 /PRNewswire-USNewswire/ -- MAPS, the ACLU, and a
broad array of medical and public policy groups nationwide commended
today's official recommendation by Drug Enforcement Administration (DEA)
Administrative Law Judge Mary Ellen Bittner that University of
Massachusetts- Amherst Professor Lyle Craker be permitted to grow
research-grade marijuana for use in privately-funded government-approved
studies that aim to develop the marijuana plant into a legal, prescription
medicine. Judge Bittner ruled that it is in the public interest to end the
federal government's monopoly, which it has maintained for over six
decades, on the supply of marijuana that can be used in FDA-approved
research.

"This ruling is a victory for science, medicine and the public good,"
said Prof. Craker. "I hope Administrator Tandy abides by the decision and
grants me the opportunity to do my job unimpeded by drug war politics."
The ruling by DEA Administrative Law Judge Mary Ellen Bittner, who is
appointed by the U.S. Department of Justice, marks a unique window of
opportunity in the six year struggle by MAPS and Prof. Craker to gain a
Schedule I DEA license to grow research-grade marijuana for use by other
scientists in privately funded, DEA- and FDA-approved studies.

"For decades, politicians have said that marijuana has no proven
medical value while scientists have been denied the ability to prove
otherwise," said Rick Doblin, Ph.D., president and founder of MAPS.
The court's ruling is only a recommendation to DEA Administrator Karen
Tandy, however, not a binding ruling; thus, Tandy retains final decision-
making authority. In response, scientists, researchers, doctors and medical
marijuana patients nationwide are joining MAPS and the ACLU by encouraging
Tandy to comply with the court's finding and to halt federal obstruction of
medical marijuana research.

Thirty-eight Congressional Representatives, Massachusetts Senators
Kerry and Kennedy, and a broad range of scientific, medical, religious and
public policy organizations have already joined Prof. Craker in challenging
the federal policy of blocking appropriate administrative channels and
obstructing research that could evaluate whether smoked and/or vaporized
marijuana meets FDA guidelines for approval as a prescription medicine.

If the DEA grants Prof. Craker a Schedule I license, his proposed
research-grade medical marijuana production facility will be funded by
MAPS, a non-profit research organization that plans to design, fund, and
obtain government approval for the clinical trials necessary to bring
marijuana to market as a fully legal, prescription medication. MAPS has had
two FDA- approved marijuana studies blocked by NIDA, and would require a
reliable, high-quality supply of research material to justify the time and
expense to sponsor FDA-approved clinical research evaluating the risks and
benefits of marijuana as a potential FDA-approved medicine.

The ACLU and the Washington D.C. law firm Jenner & Block, LLP are co-
counsel for the case and are assisted by Steptoe & Johnson, LLP. For

My cousin is so far to the right he attended one of those tiny ultra-conservative colleges, was one of Ken Starr's minions, he's a lay member of Opus Dei. This guy makes Grover Norquist look like a Commie.

He also worked for the Justice Department, and was involved in a lot of drug indictments.

At a family dinner, he popped out with "marijuana should be legalized, the whole War on Drugs is a big joke."

His mother, a proud John Birch Societ member and personal friend of Phyllis Schafley's, was shocked. "How can you say that???!" "Mom, if you had seen what I had seen, you'd say the same thing. We get one guy, and there are ten waiting to take his place. It's causing more problems then it's solving." His mother was practically hyperventilating, but he wouldn't back down. "You go try to prosecute drug crimes, and then come back and we'll talk about it."

Greetings, folks. Old and new DUers alike. It is good to be "home" here, if only for a minute. Of course, I have learned from my federal Bureau of Prisons halfway house roommates that a "minute" in prison can mean anything, including 17 years behind bars.

I appreciate Wiley posting Bob Koehler's column, and appreciate Bob's usual laser-clear grasp of an issue and his smooth-flowing language in presenting it. I also appreciate all of you who have read Bob's article, who have visited the www.saveberniesfarm.com web-site and who have contributed what you can (including good vibes) right now. It is nice (and more than a little humbling) to know such people (and to be borne by them -- by you -- at this moment.)

While I have really missed access to DU on a regular basis (this visit is stolen from my lunch hour at my landscaping job), I am heartened by what my fellow ERDUers have accomplished in moving us toward free, fair and verifiable elections. We are certainly not there yet but we are moving in the right direction and there are sure as hell more than "6 or 7" of us marching together now to save our democracy. The phrase should be "right makes might", not the other way around. As with verifiable elections, access to medical cannabis on demand should be something we come to expect in this country. We might just get there, if we can ever count the votes as they are cast.

My decision to become more public about my case, and the circumstances surrounding it, may certainly come at a cost. The fact that the feds have moved the civil asset forfeiture case from the "inactive" file and are now moving to set it for trial is one inkling that the next phase of this adventure is about to start. If I can raise the funds needed to offer the feds something to drop the case, I may just end up being able to hold on to the farm where my heart lives. The outpouring of support in the middle Tennessee area has been so nice, and the consciousness-raising opportunity that we have at this moment -- in this time and place -- cannot be wasted. The April 25 "Save Bernie's Farm" benefit will be well covered by the local media, and there will be a 8-10 page story on my case in the Nashville Scene on that day. (It will be the cover story.) We need the Belcourt Theater to be packed on that day, so if you know anyone in the middle Tennessee area, please contact them and ask them to come to the benefit (and to order their tickets today at www.belcourt.org ). I would also appreciate it if you could send Bob Koehler's column out to as many of your sympathetic friends as possible and to ask those who can afford it to make a contribution and/or to send their good vibes. And then ask them to forward the Koehler column on to their own email lists and listservs.

For those of you out of the area, you will be able to hear the April 25 "Save Bernie's Farm" benefit in its entirety (all 3+ hours of it) by going on-line to www.radiofreenashville.org . The musicians who have volunteered their time are stellar -- some of the most respected studio musicians in Music City -- so it should be an amazing show. And the Executive Director of the National Organization for the Reform of Marijuana Laws (NORML) is coming to Nashville to emcee the show. (We will have other prominent speakers there also.)

There is no way to know where this journey will end, but if we all just keep doing the next right thing and work for what is right and just (and caring and compassionate and common-sensical and rational and natural), then our planet and our people will benefit in the future for the time that we spend here together.

As my Hopi elder teachers have said so clearly, "we are the ones we've been waiting for."

50. Koehler column widely reprinted -- thanks Bob and thank DU
Bob's column was picked up yesterday by Huffington Post, OpEdNews, BuzzFlash, the Voters Unite newsletter and other sites. It also ran on the top of the "Opinion" page today in the Nashville Tennessean. As Bob told me in an email late yesterday, "this column has struck a nerve."

If your hometown paper runs Bob's columns and has not run his "Devil Weed" column yet, give your editor a call. It would be nice to see this column printed as widely as possible. Thanks kindly.

53. I look forward to rejoining this band of patriots soon (May 10, I hope).
Though before I re-hook my home computers to the Internet, I'll have to repair my plumbing, de-tick my dogs, plant the garden and bush-hog my pastures, which are all overgrown in briars and young scrub trees now after seventeen months of enforced absence. Oh well, a farmer's work is never done anyway -- I just won't have to look for things to do for a good while upon my return.

Thanks again, Wiley, for starting this thread. This morning, I received an email from a friend in China who had read Bob's column and a note from a New York literary agent interested in my halfway house diaries (most of which are now posted at my web-site www.saveberniesfarm.com ). We'll see just what comes from all that.
