Move over Joe the Plumber. Make room for Frank the Firefighter
WASHINGTON — Republicans plan to call a white firefighter whose reverse discrimination claim was rejected by Supreme Court nominee Sonia Sotomayor to testify against her.

New Haven, Conn. firefighter Frank Ricci brought a lawsuit challenging his city's decision to scrap the results of a promotion test because too few minorities scored highly enough to qualify. He's one of 14 witnesses Republicans will call during Senate hearings on Sotomayor's confirmation that open Monday.

Sotomayor was part of an appellate court panel that rejected Ricci's claim. The Supreme Court reversed the ruling last week.

Democrats' witnesses include New York Mayor Michael Bloomberg, former FBI Director Louis Freeh, and former Major League Baseball pitcher David Cone.

My understanding of the appellate panel ruling on the case was that it followed what was then the Supreme Court's previous ruling. That is to say, an appellate court can't overrule the Supreme Court. The Sotomayor panel did just what it was supposed to do, and that was to follow established precedent (that whole stare decisis thing).

When the Supreme Court issued its ruling, which reversed its earlier ruling, they did what only they had the power to do in terms of establishing a new precedent. I'm guessing that all of this legal folderol will be lost in the rush of the Republicans to get Frank the Firefighter's deathless testimony.

when the judge answers him, the telelvision will show him with a deer in the headlights look. He won't know what the hell she is saying, because she knows the law and he doesn't.

if you think a judge is supposed to follow precedent and interpret, rather than make, the law. That being said, what the hell does it add to have this guy testify? Can he sit there and cry about how the big bad Latina hurt his feelings? I hope the Republicans really go after her; she going to win in the end and, except for a few Cubans in Miami who think the GOP will invade Cuba one day and give them back their parents plantations, they will lose the Hispanic vote for a long, long time.

Oh, and a big hello to Catwoman; haven't seen you here in while:hi:
