WASHINGTON – Attorney General Eric Holder is considering whether to appoint a criminal prosecutor to investigate the Bush administration's interrogation practices, a controversial move that would run counter to President Barack Obama's wishes to leave the issue in the past.

Holder plans to make a final decision within the next few weeks, a Justice Department official told The Associated Press on Saturday night. The official spoke on the condition of anonymity because he was not authorized to speak on a pending matter.

Justice Department spokesman Matt Miller said Holder planned to "follow the facts and the law."

"We have made no decisions on investigations or prosecutions, including whether to appoint a prosecutor to conduct further inquiry," he said. "As the attorney general has made clear, it would be unfair to prosecute any official who acted in good faith based on legal guidance from . . . .

"I hope that whatever decision I make would not have a negative impact on the president's agenda," Holder told Newsweek. "But that can't be a part of my decision."

5. The only way this can work is if it doesn't look like a witch hunt... Holder has to look independent

from Obama and the party.

Obama needs to be "above the fray".... or it will just be considered another partisan witch-hunt.

8. and it failed...

...because the American people saw it as such.

Clinton was acquitted in the Senate, and left office with a ~60% approval rating.

The Republican coup attempt of 1998-99 failed, precisely because it was a political witch hunt.

Sorry... I'd like to succeed this time. I'm not interested in tit-for-tat. I want Cheney's ass in jail.

Use your head.

dumbo to enable the SCOTUS to steal the election

if the M$M hadn't been behind the push to impeach, Gore would have won in by a very comfortable margin, rendering Florida moot

I know this for a fact, as I have access to parallel universes

9. It was a witch hunt started by republicans.
So we should do the same thing?

I'm not sure what point you're making.

12. Just turn it over to the World Court and be done with it.
There is no way they could charge witch hunt then.

10. When some sub-cabinet appointee does something it's always the administration's fault
So now that an appointee does something you agree with, Obama doesn't get credit.

19. Obama's public preferences?
I suspect that the two confer more often than we know. Obama's long game absolutely requires that he appear uninterested in prosecuting the last Administration. Whatever other instruction he give the AG (or not) might tell a different story.

3. Holder is considering "whether" to appoint a criminal prosecutor.
Edited on Sat Jul-11-09 11:01 PM by Lint Head
I would be very surprised to see that he has the balls to do a damn thing. These criminal pricks should have been prosecuted and jailed years ago! Time is running out for the statute of limitations and they know it. The government is letting it run out because political 'suits' have a very hard time holding any of their so called com-padres accountable.

15. We have begged and begged and begged
I don't hold out much hope. Unfortunately, unless he appoints someone who agrees to do his or her job, without fear or favor, it's not even worth the appointment.

16. Hmm... I wonder...
"...it would be unfair to prosecute any official who acted in good faith based on legal guidance from the Justice Department."

If the "legal guidance" was coerced, does it still indemnify "officials who acted in good faith"? I'm not suggesting the Bush Administration waterboarded its lawyers in order to get them to sanction waterboarding. (Well, come to think of it...) However, it's no secret that Bush and Cheney communicated to WH lawyers the answer Bush and Cheney wanted to hear.

20. Sounds to me like Holder's testing the water...
"We have made no decisions on investigations or prosecutions, including whether to appoint a prosecutor to conduct further inquiry..."

If we, the people, make some noise, he appoints a prosecutor. If not, it's the last we hear of it.
