The captors could do a little torture of their own to solicit this testimony. One of two things would happen then...
Either:
a) Cheney "proves himself right" by showing that they were able to get the truth out of him through torture, and basically get the goods on everyone so that we can proceed with prosecutions. That or Cheney will claim that what he said was solicited out of him and wasn't the truth, and he'd prove that torture can be used to provide "false but desired" information (like what they did to justify going to war).
or
b) Cheney can prove himself wrong by standing up to torture and show that they can't get the truth out of him through torture and that the administration didn't commit criminal acts. It would then show that this program was useless and just a criminal breach of the Geneva Conventions since it didn't work in getting the truth out of him. Of course Cheney would subsequently say that he was telling the truth and that Bushco didn't commit any crimes. Well if he will say that they didn't torture anyone, then that would reverse the recent statements saying that they did...
There's so many ways this could be used to fuel getting the previous administration prosecuted! Sounds worth it to me!!! :evilgrin:
