Crowley considering a defamation lawsuit against Gates (ABC News)

The police sergeant who arrested Harvard University Professor Henry Louis Gates Jr. last week in his own home may be considering a defamation lawsuit against Gates who has implied his arrest was racially motivated.

Alan McDonald, who represents Sgt. James Crowley, said the veteran cop who teaches a racial profiling class for rookie police officers has not ruled out filing a defamation of character or libel lawsuit.

"He is exploring all of his options,'' McDonald told ABC News.

16. I Think You Are Spot On Here.......
the Repugs see Obama's 'stupidly' remark the other night as a misstep by him and along with the MSM are going to keep this issue alive as long as they can. Anything to divert from the real issues and any wedge they can slide in to make some inroads in 2010. Given Rush's comments about this Gate's incident and cops and his tying this to Sotomayor's firemen - the next logical step if the Repugs hold true to form is for them to glom on to Crowley and put him on the road for them Joe the Plumber style.

Then they'll have Sarah Palin, Joe the Plumber, Crowley the Cop, Michelle Bachmann, Pat Buchanan, The Family and the Residents of the House on C-Street, all the RW talk show hosts and RW apolgists - oh - and lets not forget the Birthers - all taking shots at Obama. Did I forget anybody?

... and that would likely include lawyers who would hire the type of researchers (read: private investigators) who know how to uncover, say, a law enforcement official's penchant for doing personal stuff while on duty, or porn collection, orliberal use of the "N" word (I'm not saying Crowley has ever used the "N" word, but if he has, "Kitty, bar the door!").

Crowley had best ask himself: does he have anything to hide?

Crowley's own actions did that, and it was more like 'exposed' than 'defamed'.

Bad cop is looking for income since he knows his bad cop days are numbered.

Prof. Gates has demanded an apology from Crowley and if he does not get one, he may sue Crowley and the City. I think that Prof. Gates has a very good lawsuit here and that Crowley would be stupid to sue Prof. Gates.

First, it is clear that Crowley did not provide written Id as required by Mass. law when requested by Prof. Gates. Mass law requires officers to carry Id and to provide such ID if requested. http://www.mass.gov/legis/laws/mgl/41-98d.htm
Chapter 41: Section 98D. Identification cards


Section 98D. Each city or town shall issue to every full time police officer employed by it an identification card bearing his photograph and the municipal seal. Such card shall be carried on the officer’s person, and shall be exhibited upon lawful request for purposes of identification
This case would have never happened if Crowley complied with the law.

Second, Prof. Gates conduct was protected by the First Amendment. The law is clear here and the Mass disorderly conduct law does apply to protected speech

We have a false arrest based on a violation of Prof. Gates' First Amendment rights. That is a far better case than Crowley's so-called claim

Your assessment is naive and wrong. Crowley is only considering a lawsuit to fend off a possible lawsuit by Prof. Gates. Crowley violated Mass. Law and the arrest was bogus. The Mass. disorderly conduct law excludes conduct protected by the First Amendment. The SCOTUS has ruled in the Houston v. Hill case that the First Amendment covers protesting arrest and charges of disorderly conduct.

I think that Crowley has a very weak case and that Prof. Gates has a better case.

Again, I am also a lawyer and I think that your assessment is just plain wrong.
