DURHAM -- The N.C. Court of Appeals has ruled that former Duke University lacrosse coach Mike Pressler may proceed without arbitration with a slander lawsuit he has filed against both the school and former school spokesman John Burness.
The suit arose out of the false rape allegations a stripper made against three members of the Duke men's lacrosse team in 2006.
Duke had appealed an earlier ruling by Superior Court Judge Howard Manning that allowed Pressler to pursue the lawsuit. The appeal contended that Manning erred in April 2008 when he ruled that a March 2007 agreement between Duke and Pressler nullified the coach's contractual obligations to submit employment-related claims against the school to arbitration.

The defamation suit against Duke and Burness came after Pressler claimed the former university spokesman slandered him in interviews with The Associated Press and a newspaper in New York. Burness allegedly implied that Pressler hadn't controlled his team and compared him unfavorably with his replacement, current Duke lacrosse coach John Danowski.
