Indiana man allegedly forced to pee for police

<snip>

According to the suit, police arrested Jamie Lockard, 53, on suspicion of drunk driving in March. A Breathalyzer test showed he was under the legal limit, but Officer Brian Miller doubted the findings.

Lockard and his attorney claimed in the suit that police took him to Dearborn County Hospital and forced him to submit to a urine test.

Police said they obtained a warrant, but Lockard's attorney said his client was shackled to a gurney and had a catheter inserted against his will.

"It has to be executed reasonably," said attorney Doug Garner. "No one would say this is reasonable behavior. It's reprehensible that anyone could think that this is appropriate." <snip>

Garner said the police officer did not apologize, but instead charged Lockard with obstruction of justice.

1. The Supreme Court ruled unconstitutionally
for illegal search and seizure by authorizing pee and other forms of body tissue/fluid testing. I gave urine while in the U.S. Army, but never again. And this has cost me housing and jobs, but that is no reason to submit to this form of illegal and immoral behavior by people who don't respect privacy and the right to be free of illegal search and seizure.

3. "Garner said the police officer did not apologize." Public servants have such delusions of grandeur

4. It's a two way street.

If the officer doubted the results of the Breathalyzer it seems to me that anyone who was convicted solely on the results of the same Breathalyzer in the past should at least have their cases reviewed simply because the PD has no confidence in the results of a test from that device.

5. With the Breathalyzer reading that he was below the limit, what was the probable cause?
Lawyers will have a field day with this one.

7. they were looking for drug metabolites
We all know how long cannabis stay in your system,but the courts do not realize that you cannot test for cannabis only cannabis metabolites, and that only proves past use not present intoxication!

9. Maybe they will pull a college prank on officer Brian Miller
and transport him to Cincinnati, strip him, blindfold him, and let him off in an abandon neighborhood.

In a town as small as Lawrenceburg that everyone knows the officer and who knows what their feeling is toward the idiot.
