Make them pay back every penny they over billed, and if they don't have it all take what they do have!

4. That's ridiculous since we'd deprive ourselves |

of the fruits of his education, the repayment of his student loans, and restitution. We'd also have to support him for the duration.
A better one: suspend the license for a year, force restitution plus penalties, and audit everything he does for five years when he returns to practice.
Ultra punitive measures might satisfy some primal need for vengeance but wouldn't do any good in either the short or long run. We want to modify his behavior, not destroy everything in sight.
In addition, it's really hard to get convictions when the punishment is so Draconian.

6. While it satisfies your primal need for vengeance |
|
it's destructive in the short run and in the long run.
Do you really want to support these guys in prison for the rest of their lives or do you want to hit them where it really hurts--the wallet--and force them to practice honestly for the rest of their lives?
The latter is going to be much harder on them.
