There will be no ACORN lawsuit
A lawsuit would entitle FauxNews to search ACORN offices virtually at will during the discovery process, and ACORN has a history of refusing that type of access. I will leave it up to you to draw your own conclusions about why an organization would be loathe to have a third party going through its books and emails.

Mark my words, there will be no FOX vs. ACORN lawsuit.

why would ACORN not want FakeNews going through their books?

They make shit up and distort shit every 30 seconds on Fox. It wouldn't matter what the truth was, Fox would claim they searched the ACORN records and then make crap up to suit their agenda.

Meanwhile Fox would NOT want ACORN or anyone else to ever go through their records and uncover the collusion between them and the GOP leadership.

Right. I can't imagine why ACORN would want to prevent FOX from going over their records with a fine-tooth comb, given FOX's part in the ACORN witch hunt that has been going on since before the last election.

IOW it is not just any third party we are talking about here, it is one of the most rabid right wing organizations in the country we are talking about.

In any case, ACORN is now in deep trouble, and I am sorry to see that. My sincere hope is that someone can prove this was bought-and-paid-for theater. My second sincere hope is that we can see some of the other videos that were made, you know, the several instances where ACORN people did not go along with the fake plans.

court cases in Maryland in which undercover surveillance by the press has most often been won by the press,
for the freedom of the press is powerful and can trump a state law such as the Maryland law prohibiting such use.
Of course the videos can't be used to prosecute the employees, but it sure can get the IRS and other agencies worked up.

For instance, with the power the IRS has, they can pull any tax forms filed by the employee(s) in question and review them.

a house of Prostitution in Maryland. They could receive up to 25 years for each of the 13 counts of conspiring in the human trafficking of minors expressed in the conspiracy. Forget everything you know about conspiracy charges on the federal level and in your state. Maryland's Conspiracy law are Unique and would facilitate a prosecution for planning to operate a house of child prostitution. Going to acorn to enlist Coconspirators is an overt act. Maryland law does not require an overt act to support a conspiracy charge. Just and agreement and intent to promote and facilitate violation of substantive law.

Btw, the fact that they have exposed the conspiracy and disavowed it before the commission of the actual crime has no bearing in Maryland law. That is irrelevant to the Conspiracy charge.
