Hofstra Rape: Student Lied About Incident: District Attorney

HEMPSTEAD, N.Y. (AP) -- Authorities in New York say the Hofstra University student who told police that she had been gang-raped by five men on campus has recanted her story.

Nassau County District Attorney Kathleen Rice said in a statement released late Wednesday that the 18-year-old told law enforcement officials that the sex was consensual.

The woman had accused the men, including a Hofstra student, of taking her cell phone at an on-campus nightclub and luring her into a dormitory men's room and sexually assaulting her early Sunday.

Four of them, Rondell Bedward, Jesus Ortiz, Kevin Taveras and Stalin Felipe, were arrested and arraigned on rape and other charges.

1. The innocent accused faces are still all over the place....
while we still don't even know the adult false-accuser's name.

Nor is does she as yet have any charges.

Wonder if she put the backwards 'B' on her face before or after her night of fun.

False rape accusations hurt the accused, obviously. But they hurt all *women* who really *have* been raped as well. It would be nice if women would speak out against this - for everybody's benefit.

2. I don't know if I would call five guys who gang-bang a woman "innocent"...
"Not guilty" of rape, sure! "Innocent"...I have a hard time calling them that.

4. the innocent was referring to whether they raped someone
as for whether you think they are "innocent" beccause of consensual sex, that's another issue.

8. Federal and state statutory law say differently. In the end, that's what holds up in court.
And that's what should matter the most.

6. I think I'll speak out on other subjects.
I really don't know what happened here. Did the sex not occur? Did how many? One? Four? Five young men? Have sexual intercourse with the same woman in a bathroom? AND WE'RE CALLING IT CONSENSUAL? I really need so much more information about the nature of the Come one, come all! consent. Because right now I have no idea how people of both sexes wound up in the same bathroom.

Yes, that's what they call it when a woman agrees to have sex... consensual. Believe it or not, there are some women who *enjoy* sex with multiple partners at the same time.

Do you have a problem with that??

5. This was unrecommended by someone,
probably a person who still haven't gotten over the fact that the Duke players were also innocent, and that the woman LIED.

9. Yes. but did we have a crazy faculty
that retaliated against other members of the sports team. Judged the accused guilty and spoke out accordingly. Led a large protest that included threatening to castrate the accused.

and that holds for investigators in general.

i've investigated scores of rapes, and you ALWAYS enter the investigation with the understanding that it could be a false complaint.

as dershowitz once said, rape is simultaneously the most overreported and underreported crime.

unlike many other falsely reported crimes (like burglary, which is often false, for insurance purposes) false rape complaints usually name a suspect(s). iow, these false complaints put people in jeapordy (in the legal sense) vs. other false reports.

Your "feeling" is a projection of your desire to find a lack of consent, and in fact, even more sinister coercion, in the absence of any evidence to that effect.

21. The two situations are not identical
This woman admitted to making up the story, and is now under investigation. In the Duke Case, NC Attorney General had this to say:

Q: Do you believe the accuser lied in this case? And will there be any criminal charges against her?

COOPER: Well, we have considered that. Our investigators who talked with her and the attorneys who talked with her over a period of time think that she may actually believe the many different stories that she has been telling.

And in reviewing the whole history, there are records under seal that I'm not going to talk about, but we believe it's in the best interest of justice not to bring charges, and we have made that decision, as well.

19. Wow! I wondered why it is no longer in the news
It should. Rape is a serious matter and any woman (or man) who lies about it makes it harder for the next victims.
