Love Stuff Loses Challenge to Sex-Toy Ban in Alabama Supreme Court

The Alabama Supreme Court has ruled against a store called Love Stuff in a suit challenging the state’s ban on sex toys.

The 7-2 decision held that people have a right to use sex toys in private, but the legislature may ban public distribution of the devices, the Birmingham News reports.

Writing at the Volokh Conspiracy, UCLA law professor Eugene Volokh says federal appeals courts have split on the constitutional issue and there is “a decent chance” the U.S. Supreme Court will hear the case.

Vokokh's post includes his prediction of last year that the court will uphold the sex-toy ban, and the vote will be 6-3.

a very interesting subject in that a state is limiting the sale of a product sold in other states. Perhaps a challenge to tobacco in the Alabama courts is in order. This is a product that kills. I know there are a million jokes here but I am restraining myself at this point.

15. So. Alabama wants folks either to pay taxes to other states for sex toys, or get them via the Web?

Seems to me no states can afford to turn up their noses at potential tax revenue of ANY kind these days. Alabama is forcing its citizens to get their sex toys from other states or on the Internet. Either way, neither municipalities nor the state will get any tax revenue from Love Stuff and others.
