Orly Taitz to Continue Battle with Judge Land

Yay! Orly announced today she will respond to Judge Land's warning, and thus will surely find herself with a $10,000 fine and possible further sanctions.

The "Birther Movement" continues to disintegrate. In our continuing saga, Orly filed a complaint on behalf of an Army captain questioning Obama's legitimacy as Commander in Chief. The case was thrown out of court by Judge Land. So Orly filed a Motion for Reconsideration so full of inanities, insults and threats that the Judge responded with an Order denying the motion and offering Orly the opportunity to show why she should not be fined $10,000 for filing a "frivolous" motion.

Orly takes the bait. She is now busily composing yet another attack on Judge Land. I can't wait to see it!

I am submitting tomorrow to judge Carter a response to defendant’s motion. I will be busy today and tomorrow and will not have much time for blogging. Thank you for understanding.

I will respond to Judge Land’s outrageous attack and threat of sanctions. This is very similar to what I have seen in the communist dictatorship in the Soviet Union. When judges refuse to hear the cases on the merits, when they summarily dismiss the case within a couple of days while they are supposed to give the counsel 20 days to respond by their own rules, when they take away from the plaintiffs their right to trial by jury, when they stifle free speech and take away right to counsel by threatening $10,000 sanctions if the attorney ever brings Obama illegitimacy case again, that is tyranny. That is judiciary as well as the top brass in the Department of Justice and Department of Defense colluding in perpetrating massive fraud and treason on the citizens of this country and taking away their constitutional rights. What is next? They will throw me in FEMA GULAG? I hope each and every citizen of this country rises against this tyranny. I will be seeking all means of redress available to me by law. I will be seeking Rule 11 discovery to prove that Obama is indeed illegitimate, my case was not frivolous and not only I don’t owe $10,000 in sanctions, but the defendants owe costs and my reasonable attorneys fees. These fees just went up significantly.


It must be illegal to threaten to extort higher fees in response to a Judge's Order, right?

Her client has already asked that Orly be removed from the case and stated that she did not authorize Orly's http://ia311028.us.archive.org/1/items/gov.uscourts.gamd.77605/gov.uscourts.gamd.77605.15.0.pdf">latest court filing in response to the Judge's dismissal of her case (in which she accused the judge of TREASON, among other things). Further, she announced she would file a complaint against Orly with the California bar.

A commenter at Daily Kos outlnes Orly's possible violations:



1. Filing a document without your client's consent, or even consulting your client at all.
2. Filing a patently frivolous document without any legal support whatsoever.
3. Soliciting funds from non-clients to pay for representation of your client.

The third might be the worst. There are very strict rules preventing non-client third parties from funding another person's representation. It can happen in some limited circumstances (for example, parents paying for their child's legal defense, etc.), but waivers have to be obtained and rules have to be followed. Soliciting money on the internet to fund litigation is nowhere close to ethical (if, in fact, she is using that money to support her litigation).



I can't wait to see her next filing, as promised, in response to the Judge's Order!


She has provided no legal or factual basis for the Court to interfere with deployment orders of the United States Army. She supports her claims with subjective belief, speculation and conjecture, which have never been sufficient to maintain a legal cause of action. She continues to file motions that do not address legal issues but that describe the President as a "prevaricator," allege that the President’s father was "disloyal and possibly treacherous" to the "British Crown," accuse the undersigned of treason, and suggest that the United States District Courts in this Circuit are "subservient" to the "illegitimate" "de facto President." Although the First Amendment may allow Plaintiff’s counsel to make these wild accusations on her blog or in her press conferences, the federal courts are reserved for hearing genuine legal disputes and not as a platform for political rhetoric that is disconnected from any legitimate legal cause of action.

The Court finds Plaintiff’s Motion for Stay of Deployment (Doc. 15) to be frivolous. Therefore, it is denied. The Court notifies Plaintiff’s counsel, Orly Taitz, that it is contemplating a monetary penalty of $10,000.00 to be imposed upon her, as a sanction for her misconduct. Ms. Taitz shall file her response within fourteen days of today’s order showing why this sanction should not be imposed.

It's a last chance to acquiesce to the judge, apologize for bad behavior, and avoid the monetary portion of the sanctions.

Instead, Orly is going to commit a crime. She will display contempt of court and go to jail over it.

But she sure will play the martyr thing up -- especially when she gets fined and when she doesn't pay it, jailed for contempt. Do attorneys every get ordered to have (mental) competency hearings? She is spinning even out of reality with her delusions.

22. The long form, of course.
Must have name of judge swearing her in, date and time of swearing in, and location of courthouse or other venue. She got her citizenship through marriage -- I'm not sure how that works.

54. Well, the judge can order a psychological
exam. I was observing in a court-room once when a psychological evaluation was ordered. The woman in question was an alcoholic and the judge was considering jail, but wanted to establish if she understood what was going on. I thought she was acting a bit crazy, but I have to say, Orly makes that woman look completely sane.

Maybe all this will work out for the best and she'll finally get the help she so badly needs.

but I guess I didn't pay attention to who they claimed would be running them. Of all agencies, the very one that was gutted by Chimpy and Skeletor. Ironically your search link includes one to a Glenn BecKKK interview that debunks the whole thing by noting the fact that their most prevalent lunatic videos include pictures of what is really an Amtrak repair facility that they claim belongs to FEMA.

Larry Sinclair (yeah, you're right, THAT Larry Sinclair) has declared the fax a forgery.

Freepers and other assorted Republican (aka "Birthers") have jumped on this and accepted his analysis of the fax being a forgery (much like Republicans also jumped on the bogus "analysis" by Polarik of Obama's birth certificate).

The Republican PArty is now the party of Birthers. They own the Birther crap lock, stock, and barrel.

In fact, with time, he probably could have found EVEN MORE against her.

I just hope Judge Land keeps his wonderful snark in tact while demolishing this beyond batshit crazy woman. I love reading his decisions, combining the law with a perfect quote from Yogi Berra with his Order was sublime, imo.

DEFENDENTS have a right to trial by jury. Plaintiffs have no such right.

I learned that in 9th grade civics.

Why doesn't a lawyer know this?

66. I've heard some paralegal friends discuss her "law school."
All they teach is how to pass the California Bar exam. Okay if you already have something of a law background (as my friends and I do (I'm NOT considering it) but not if you want to be taken seriously by the Court.

Start with SHE ACTED WITHOUT HER CLIENT'S AUTHORITY.

That means she has NO STANDING to continue any kind of action on the merits of this matter. All she has standing to do is defend herself in the Court's Show Cause proceeding, scheduled in the next couple of weeks. She had better get counsel for that, preferably someone who DOES understand federal courts and the rules which are enforced there.

She's going to commit contempt of court. The only question is how hard the judge hammers her.

Here's one of her rationales for Rhodes' right to resist deployment. From the filing:

"the historical importance of an independent army corps to the constitutional balance of powers and Republican Form of Government guaranteed by the Constitution"

So now the military is an independent fourth branch of government. This is really nutty stuff.

This Rhodes ought to be declared AWOL and jailed right away. This law suit is beyond idiotic.
