Juan Vera is not a public figure. |

Edited on Mon Sep-21-09 06:28 AM by Tommy_Carcetti
Hence, he does not need to prove "actual malice" in order to prevail in a defamation claim, like public figures do. Therefore, he would not need to prove that Fox News and O'Keefe intentionally tried to hurt his reputation by publishing false information about him...all he needs to do is show that they published false information about him, regardless of their intent.
I hope the guy sues the rat bastards for every possible penny.

1. The raw video has been or is being erased, wiped and double wiped... |
|
All hard drives are being destroyed.
Bet your ass on that. Only the highly edited versions will remain.

4. We'll see. I think O'Keefe is under investigation in Md for videotaping without consent.... |
|
and NY wants the raw video for a criminal investigation.
My sense is that this will blowup in their faces. Unfortunately, the blowup will be slow due to the massive legal resources of the far right and it will get very limited media coverage.
Smear on Page 1 - retract on page 28 two years later. Very effective tactic.

3. Also, what kind of "investigation" is it |
|
where you just walk in off the street and start talking sh*t to someone you've never met before and have no prior information about? Of course the Acorn employees were confused by O'Keefe and his bizarre story, most people would be.
It was a stunt, not an investigation.

5. Someone Needs To Sue That Shitstain... |
|
Yep...not only would I like to see the "dry" video but also any scripts and correspondence regarding this STING (it was a set up, not an "investigation). Let's not only find out how set up and staged this stunt was but also how many in the videos were a victim of entrapment.
I think it'd be great if someone who is agrieved by this hit job do sue. Yep, they' aren't public figures and if this incident prevents them from finding jobs or creates other hardships and it's proven Mr. "filmmaker" set him/her up, I hope the kid's dad has a lot of money (or Morton Blackwell)...the suits will be fast and furious.
This is one of the sleeziest things I've seen come from the rushpublicans...and that's saying a lot considering all the sleeze that is their regular modus operendi. This "filmmaker" is playing fast and loose and my hopes is he gets consumed by his own fire.
