Time was when under law that was EXACTLY what would happen. In point of fact, if they are criminals, then torture and years of confinement without charges and legal representation would insist on this, or if "enemy combatants" then Geneva conventions apply as they would more properly be called prisoners of war. Enemy combatants has no legitimacy, nor torture any sanction under any US or international law. The Bush construct of a third category that named them as neither fish nor fowl is bullshit-even Adolph Eichmann on trial in Israel was not tortured. I have no idea how this will be resolved but I see no outcome that will not be a stain on my country's honor...

You're right. But our country's mood on this matter remains bloodthirsty.
And even if they're acquitted - or the charges dropped because of the torture - they will still be held on other charges.
Worst case possible (best case for them) is immediate deportation, and in my view that's less likely than my flying by flapping my arms.

Even if they were found innocent (ha!) and even if we still let them go (double ha!), they would be deported. They're not US citizens. Finding someone innocent doesn't get them a Visa or a Greencard, for pete's sake.

when the defendants are pre-determined by all to be guilty and unlikely to be freed in NYC or anywhere else.
I think they should have a trial in NYC or surrounding area, don't get me wrong. I'm just concerned with the idea that from Obama to Clinton (Hillary) to our pundits to folks on here, everyone is decided that the reason that it's okay for NYC to be the trial site is because we all have determined that they'll be found guilty.

safe... I don't think their cohorts are intent on destroying them - then again, I don't pretend to understand how their hateful, violent thinking works.
It just doesn't make sense that their being in NY threatens NY. It's the millions of Americans in NY (and the rest of the US) they want to kill, I believe, all of whom don't seem to have felt the need to empty out the city because of them...
The legal issues of a trial are more confusing, I think... and I'm not sure, given the circumstances, a civilian trial would be all that useful. The reason for this, unfortunately, can be blamed on the previous administration and their treatment of these killers.
Actually, such a conflict might have a positive result - if it gives blatant provenance at how stupid and egregious and illegal such treatment was. How can these guys be tried as if they had typical arrests and charges? It's crazy... Bush really screwed this up, too. We can't just execute them, an ordinary criminal trial is inappropriate... what protocols do we have in place in our legal system for someone who's been tortured nearly 200 times? Exactly. Thanks, George.
