Judge to decide whether Scott Roeder can use "necessity defense" tomorrow
Tuesday is going to be a big day for the man charged with killing Kansas abortion provider George Tiller.

Judge Warren Wilbert is scheduled to hear several pretrial motions Tuesday morning, including Scott Roeder's request for a change of venue and whether Roeder can use the "necessity defense," arguing Tiller had to die to save the lives of unborn babies.

Roeder's trial is about a month away, with jury selection scheduled for January 11, 2010, and expected to last a week. Roeder's actual trial is likely to begin January 19 and last two weeks.

In early November, Roeder reportedly confessed to killing Tiller in an interview with the Associated Press.

The very rule of law in the US rests in this judge's hands, Scott Roeder and the militant anti-choicer Army of God types envision an America where people can murder other people just because the victim is doing something that the killer thinks should be illegal, let's all hope that Warren Wilbert makes the right decision and chooses not to let their vision for the United States come to pass.

1. Roeder's defense is being bankrolled by rabid RRR fanatics who will absolutely take this all the way
to the Supreme Court.

If Roeder is convicted, it's on a fast track to the appeals court--Wilbert can't win no matter what he does. I hate how politics has become part and parcel of American justice. :mad:

2. The key part of that section is "unlawful physical force by such other person"
Since abortions are legal (for now,) that doctor-killer doesn't have a legal leg to stand on.
