Do you believe incompetence or deliberate manipulation was behind the Blackwater murder's release?
Edited on Fri Jan-01-10 12:02 PM by NJmaverick
Did the Bush people have an honest screw up or was there something more sinister at work? The judge had no choice but to toss the case, the question is why did the prosecutors do what they did.

WASHINGTON – A federal judge cited repeated government missteps in dismissing all charges against five Blackwater Worldwide security guards accused of killing unarmed Iraqi civilians in a case that inflamed anti-American sentiment abroad.
U.S. District Judge Ricardo Urbina dismissed the case against the guards accused of the shooting in a crowded Baghdad intersection in 2007.
The shooting in busy Nisoor Square left 17 Iraqis dead. The Iraqi government wanted the guards to face trial in Iraq and officials there said they would closely watch how the U.S. judicial system handled the case.
Urbina said the prosecutors ignored the advice of senior Justice Department officials and built their case on sworn statements that had been given under a promise of immunity. Urbina said that violated the guards' constitutional rights. He dismissed the government's explanations as "contradictory, unbelievable and lacking in credibility."

1. hmmm
"something more sinister at work" and "Bush Administration" are often used together in the same sentence.

Therefore my guess is: deliberate manipulation.

3. No.
The issue is prosecutorial misconduct vs. the rights of criminal defendants.

6. Well, yeah, but the question posed is (I believe), "Was the misconduct on purpose?" nt

11. But that prosecutorial misconduct is occuring during the Obama Administration, not the
Bush Administration.

12. What if you were the Bush administration and wanted to get a guilty person off?
the easiest way would be to have your legal team take a dive, would it not?

5. If it stinks like corruption, looks like corruption, and sounds like corruption
it is reasonable to assume that corruption has occurred here. Of course we have no evidence, but this would not be the first time that justice was deliberately perverted at the highest levels to protect the apparatus and operatives of the military industrial complex. Iran Contra, for example.

8. the fbi spent months and a boat load of money.
they used virtual 3-D to recreate the crime scene and spent months interviewing everyone involved. it would seem that the FBI did their job and had solid evidence of a crime....so it looks like someone "fixed" the the trial.

we`ll see if the iraqi government can get justice for the murdered.

15. The Bush administration just ignored the rights of defendants in
certain cases. I don't remember that the defendants were released or that the cases were dismissed, but maybe I have just forgotten. It's possible that a couple of the Guantanamo prisoners were released because their trials could not proceed due to the fact that they were tortured or that their rights were violated. Has anyone followed the details on this better than I have?
