President Obama should send two liberal nominees for Supreme Court Justices
to the Senate right now. The Constitution allows him to do it.

Of course, it would take some courage for him to do it, and for the Senate to confirm them, so it's just a pipe dream.

But, I can still dream.

3. The can add justices but it has to be voted on and approved
some time ago they wanted to make the Supreme Court nine instead of five and it was rejected.

5. Congress must pass a law changing the number of justices.
FDR tried to increase the size of the courts, using a flimsy excuse ("The justices are getting old and we have to help them with the workload",) but really to stack it with liberal justices. The excuse didn't fly, Congress refused to pass legislation to let FDR do this, and he could not do it unilaterally.

If Pres. Obama and Congress were so inclined (the lack of political will in DC is depressing...) Congress could pass a law changing the size of the courts. The hard part is persuading them to do it.

8. and, pray tell, who would vote to confirm them?
I mean ... aren't the Dems having a hard time getting a simple majority to vote for anything which Obama does do for the "people"? Let alone enough to break a phone-in-philibuster ...

6. Be careful what you wish for
because the pukes will do the same and then some when they get back in (and they always do). If you add two more now, then President Palin adds five more.

Can.

Worms.

11. the repugs would do just that
on legislation that we would not want. in this case, the sc ruling is going to damage politics, marginalize voters, and create a free for all in a vital democracy.

Obama should do this.

13. He cannot.
The Congress would have to expand the court.
