O'Keefe and friends could face Decades in Prison (charges could include Espionage)
Edited on Wed Jan-27-10 03:11 PM by berni_mccoy
First, I'm not a lawyer, but have some as friends and family members. Keep in mind, with some of these charges, that Sen. Landrieu works on at least two committees that require clearance for classified information, her work on the Homeland Security precludes defense information. By tapping her phone, there was a possibility they would intercept, and thereby release classified into to unauthorized persons (themselves at least). Here are some of the charges that could apply in this case, along with their prison terms:

1. U.S.C. Title 18 - Part I - Ch. 19 - Sec. 371 - Conspiracy. - 5 years
2. U.S.C. Title 18 - Part I - Ch. 119 - Sec. 2511 - Wiretapping. 5 years
3. U.S.C. Title 18 - Part I - Ch. 37 - Sec. 793 - Espionage - Transmitting defense information - 10 years
4. U.S.C. Title 18 - Part I - Ch. 37 - Sec. 798 - Espionage - Disclosure of Classified information - 10 years
5. U.S.C. Title 18 - Part I - Ch. 47 - Sec. 1001 - Fraud (they posed as building/telecom workers) - 5 years
6. U.S.C. Title 18 - Part I - Ch. 47 - Sec. 1029 - Fraud related to access devices - 5 years and is cause to bring in Secret Service to investigate and raise to the Attorney General
7. U.S.C. Title 18 - Part I - Ch. 47 - Sec. 1031 - Fraud against the U.S. - 10 years and $10,000,000 fine.
8. U.S.C. Title 18 - Part I - Ch. 47 - Sec. 1036 - Entry by False pretenses to property of the U.S. - 10 years
9. U.S.C. Title 18 - Part I - Ch. 47 - Sec. 1037 - Fraud in connection with email - 5 years

I'm counting upwards of 65 years.

8. Screw that. Disappear them to a black site somewhere.
Let their families wonder what happened to them for a half-decade or so. That'll learn the little enemy combatants!

12. No. Follow the money.
The money leads to bigger fish. I would bet on it.

Satisfaction with these low-level dopes is trivial.

but Scooter Libby and Cheney walk free.
Yeah, we'll throw the book at those morons. Because we sat on it when we should have thrown it at REAL traitors.

9. Hopefully, but then they'd have to make the decision as to
whether keeping your mouth shut and spending 50 years in jail, or talking and maybe not living long enough to worry about it would be in their best intersts. All depends on who was funding them and whether this was their own idea hoping for more accolades from their heroes, like Karl Rove.

7. My guess...
... they'll get charged with entering a federal building with intent to commit a crime. They'll plead out, receive probation, and wear it as a badge when they are on the RW speaking circuit.

10. I independently came up with the same list - you missed giving classified info to a foreign gov't.

13. We don't know what he was going to do with the information now do we?
He theoretically could be giving it to a foreign government - at the very least he ought to be investigated for the possibility...

14. All of that will be ignored . . . and this will become "prank" ---
Edited on Wed Jan-27-10 03:59 PM by defendandprotect
Meanwhile, I'm wondering if the DAD -- Flanagan -- was actually involved and

maybe rounded up this crew for a job?

16. While I believe they should go to prison I don't believe any of them will
I believe they will cop a plea and there won't even be a trial. They will be given suspended sentences on any time given and a somewhat large fine that will be paid by their Republican benfactors. It will all be blown over in a few weeks. But I could be wrong

17. If the plea they'll likely serve some time, *unless*
they give up a bigger fish, which, I won't be upset if they do and that bigger fish gets sent to prison for a very long time.
