Rock Star Warns Candidate Of Same Name Over Misuse Of Song
WINNETKA, Ill. (Sun-Times Media Wire) ― If Congressional candidate Joe Walsh of Winnetka was looking for attention, he found it -- but maybe not the kind he will appreciate.
Attorneys for rock star Joe Walsh of the Eagles are demanding that Walsh's campaign discontinue the use of a music video "Lead the Way," due to copyright infringement and violation of trademark laws, the Lake County News-Sun is reporting.
A letter from Los Angeles attorney Peter Paterno says the United States Copyright Act prohibits the use of "someone else's song for your political campaign promotions unless you get permission from the owner of the copyright in the song. Maybe you got so busy with the campaign that you just forgot. But that's not OK."
"Now, I know why you used Joe's music -- it's undoubtedly because it's a lot better than any music that you or your staff could have written," Paterno wrote. "But that's the point. Since Joe writes better songs than you do, the Copyright Act rewards him by letting him decide who gets to use the songs he writes."
The campaign of Walsh, a conservative, tea party Republican candidate in the 8th Congressional District, unveiled the music video using the music of "Walk Away," an early pre-Eagles Joe Walsh hit with James Gang. more...
