Breaking: Supreme Court refuses to stop DC's gay marriage law!

WASHINGTON — The Supreme Court has refused to stop the District of Columbia's gay marriage law.

The court on Tuesday turned down requests from gay marriage opponents to stop the law, which will take effect on Wednesday.

Opponents of the law had argued to Chief Justice John Roberts that D.C. voters should have been allowed to vote on the issue. Local courts have rejected the opponents' arguments. Local courts have rejected the opponents' arguments.

The city has said Wednesday probably will be the first day same-sex couples can apply for marriage licenses. Couples still will have to wait three full business days for their licenses before exchanging vows.

13. Don't get too excited
Roberts and Scalia still will be heard from when the California case gets to the SCOTUS. There's the principle of letting the local law prevail here, and the relatively few marriages that will result from the D. C. law are not enough to convince the Court's reich wing to find a way around that.

Instead, they're building 'precedent' for letting Prop H8 stand as the law of the land in California.

16. I disagree.
This doesn't set precedent for them at all.

The challenge by Boies and Olson is a whole other fish. The 14th Amendment.

It will go to the SCOTUS and Boies and Olson will be victorious. I've been posting here on this lawsuit for quite some time, by the way.

17. That's true
It's not a legal precedent, and I shouldn't have used the term, as it has a specific legal meaning.

But it would look very inconsistent for Roberts and Alito to say that local lawmakers are acting outside of their authority to legalize equal marriage, and then turn around and say that the voters of California have no right to make equal marriage illegal, when that was the norm just until recently.

Hell, I think Sandra O'Connor was the only one who ever seemed to feel the least bit of guilt about selecting Chimp on 12/12/2000.

Perhaps same sex marriage just might be one of the few areas where Opie Roberts is on the right side of an issue.
