A Solution to the KSM "Military Commission v. Civilian Trial" issue |
|
Edited on Sat Mar-06-10 06:42 PM by Krashkopf
First of all, I believe that KSM and other terrorists CAN and SHOULD be tried in Federal District Court in New York City.
To say otherwise is to - once again - allow the TERRORISTS TO WIN, by terrorizing US into rejecting our own political ideals. (When did America change from being a "the land of the free and the home of the brave" to a nation of such sniveling cowards that we can't even put mass murderers on public trial?)
Secondly if it is a "security" issue - We should simply fly a Federal Judge, and a jury, and all of the necessary witnesses, down to GITMO and hold a CIVILIAN TRIAL there.
Like most military bases, I am willing to bet that GITMO has enough guest quarters to house everyone.
By doing it that way, security AND the RULE OF LAW can both be accomadated.
Eric Holder and Barack Obama both need to GROW A PAIR on this issue, and to STAND UP FOR THE CONSTITUTION AND THE RULE OF LAW.

1. You canot hold a civilian trial based on US law on non-US soil. |

The fact is that GITMO is on Cuban soil that is leased to the USA by Cuba. That lease traces back to 1903. Cuba disputes the legality of the lease under international law. The US says "go fuck yerself."
Cuban civilian law would need to be observed at GITMO as the base sits on Cuban soil. After all, we don't allow other countries to hold trials at the UN Building, do we? The military tribunals get around that sticky wicket as tribunals may be set up on foreign soil. Happens all the time during wars.
Ergo, your solution isn't legal.
BTW - GITMO is the only US military base in the world that sits on "hostile" soil.

2. When will we come home? |
|
hundreds of military instillations world wide, some are great vacation spots for military families and roving congressmen, but they are far too costly,we need to close 90% of them and use the money for our needy citizens. All of the jobs that go to foreigners could be taken by our jobless in our country, the family housing is too costly, the schools the teachers could come home and teach in the inter ,fewer foreign brides, let them marry americans, buy american made cars, the thousands of troops would spend their money here and help our economy.

Is a strawman. It's bullshit.
Bushco doesn't want any trial. If they did there would have been trials. In fact, there was one trial already, did you hear the terrorists disrupted it? No.
But something funny did happen at that trial. A few facts about 9/11 were discovered, and it didn't look good for Bushco. You didn't hear about that either, did you?
Lets have the trial as soon as possible and show the world some America justice. And remember, it is the Cheney's who are fighting against any civilian court trial.
