It's really very simple.
Either waterboarding and other forms of torture used by the CIA under Bush were federal crimes under the Torture Act or the War Crimes Act (or some other federal criminal statute) or they were not federal crimes. If in the opinion of the DOJ they were federal crimes, then Obama or Holder should tell us why there are no prosecutions. If in the opinion of DOJ they were not federal crimes, then Congress needs to enact legislation to make them federal crimes! Executive orders and noncriminal regulations prohibiting those acts are simply not good enough.

3. I'm afraid it's not quite that simple.
Bradbury seemed to say that it is illegal unless the President authorizes it. If the DOJ holds that opinion today, citizens should recognize that we are dealing with another Administration that effectively puts itself above the law when it comes to national security.

4. But then what does that do to the US in a World Body? The US should be
chastised un forgivingly for this if they don't bring charges against Bush/Cheney for this.

5. I agree.
I don't believe that the President is above the law (nor did the Founders, by the way).

6. Law only applies to the little folk..
It certainly does not apply to the big wigs especially Republican Big Wigs....Obama has made that as plain as absolutely possible.

7. If Obama does believe that he is above the law, then fuck him.
(Call me naive, but I'm still hoping that he doesn't believe that.)
