Washington to join lawsuit over mandate
OLYMPIA — State Attorney General Rob McKenna said Monday he'll join a lawsuit challenging the health-care overhaul passed by Congress, prompting a barrage of attacks from Gov. Chris Gregoire and other state Democratic leaders.

McKenna is among at least 10 state attorneys general who say they will sue, arguing the legislation's requirement that everyone purchase health insurance is an unconstitutional expansion of federal authority.

"If the state AGs don't step up when they see a constitutional defect, then who will? It's not going to be Eric Holder," said McKenna, a Republican.

The lawsuit, to be filed after President Obama signs the bill, will argue the law violates the 10th Amendment to the Constitution and the Commerce Clause, McKenna said.

1. I guess the states have some extra revenue after all
They'll get their 15 minutes of fame and then fade away just like the others opposed to this reform.

I already emailed McKenna (I'm a Washington state resident) telling him NO WAY! Not in my name. Like the $$ angle, though.

18. Is it possible they can repeal the mandate and keep everything else?
I would applaud that. I think the mandate IS unconstitutional.

and give them momentum....even on this wonderful day.

Personally, I don't give a fuck what AGs are "gonna" do,
and I suggest that most here shouldn't either.

4. I hope the mandate is found to be unconstitutional
that, coupled with the actual good things in the bill and we may get somewhere.

for everyone is the only legal answer

16. Why should I not care?
The bill in no way helps me, not one iota,yet I am supposed to pay hard earned money to a private insurance company who can still refuse to treat me because I have cancer? I am forced by my government to pay for something that I can't use. You bet I care.

6. They can sue all they want.
The difficult part part is going through all of the courts. In the end they will lose because the government can do just about anything it wants too.

11. I know - that's what I was thinking!
I heard some talking head saying that a PO would have eliminated the constitutional basis argument the suers are relying on.
