HCR Law of unintended consequences
Well maybe not unintended but certainly consequences that will not attract votes for democrats.

1. Caterpillar has to write off $100 Million for retiree health care.
2. Deere has to write off $150 Million for retiree health care.
3. The law does not say children are covered with pre-existing conditions and insurance companies say they will follow the law. Dems deep lying saying they are covered and will have Obama issue a "regulation" to correct the error. Unfortunately regulations go to court for challenges since they are not the law.
4. CEO of Verizon memo to employees "You are so fucked". Your rated are going up substantially does to this bill and oh yea, they are going up so much that you now have "Cadillac" health care.
5. NFIB says that HCR will cost wages and employment. Different rules apply for companies employees making over 50K so they will hold wages UNDER 50k and different rules apply to companies Over 50 employees so they will hole employment below 50.
6. All the claims of help for small business but many small businesses are sub-S corporations and so they do not receive the claimed subsidies to provide health care.

Now I don't know about you but I don't see a lot of votes for dems on that list from the losers of HCR and this is only the beginning. Most old line companies like Deere or Cat will be doing the same thing and other big companies will be affected like Verizon. Toss in 500 Billion in Medicare cuts while the cost of insurance continues to skyrocket and there you have it. Victory?

10. On the Caterpillar, Deere crap
Per Gibbs:

This is a loophole that was created in the Medicare Part D prescription drug benefit. Businesses get a 28 percent subsidy to help cover the cost of prescription drugs. That subsidy they get from the government is now currently not counted as income. When they spend that money they currently get a deduction on that.

So basically they get a subsidy and what amounts to two deductions. Right? It’s not -- they get the subsidy that’s not counted as income, then they get to write off the spending.

This bill, our bill simply closes the loophole and allows them to deduct that money one time by not counting it as income. So I would say that to ensure that this is not something that’s done without any time period or planning, this doesn’t go into effect until 2013, which is two years later than the original Senate bill. There’s $10 billion in health care reform for support for businesses with early retirees.

Read Gap in health care law's protection for children
Under the new law, insurance companies still would be able to refuse new coverage to children because of a pre-existing medical problem, said Karen Lightfoot, spokeswoman for the House Energy and Commerce Committee, one of the main congressional panels that wrote the bill Obama signed into law Tuesday.

However, if a child is accepted for coverage, or is already covered, the insurer cannot exclude payment for treating a particular illness, as sometimes happens now. For example, if a child has asthma, the insurance company cannot write a policy that excludes that condition from coverage. The new safeguard will be in place later this year.

Late Tuesday, the administration said Health and Human Services Secretary Kathleen Sebelius would try to resolve the situation by issuing new regulations. The Obama administration interprets the law to mean that kids can't be denied coverage, as the president has said repeatedly.

I await their fix on this.

7. Here's Another Unintended Consequence
There's a tax on medical devices.

Here's the definition of medical device used in the Act (It's section 201(h) of the FDA code):
(h) The term "device" (except when used in paragraph (n) of this section and in sections 301(i), 403(f), 502(c), and 602(c)) means an instrument, apparatus, implement, machine, contrivance, implant, in vitro reagent, or other similar or related article, including any component, part, or accessory, which is--

(1) recognized in the official National Formulary, or the United States Pharmacopeia, or any supplement to them,

(2) intended for use in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment, or prevention of disease, in man or other animals, or

(3) intended to affect the structure or any function of the body of man or other animals, and which does not achieve its primary intended purposes through chemical action within or on the body of man or other animals and which is not dependent upon being metabolized for the achievement of its primary intended purposes.

This includes blood sugar monitors and test strips.

Did we REALLY want to raise out-of-pocket costs for diabetics? There's a bunch of fixes needed in this bill.

11. Let's add
The requirement for all business to file 1099 forms for every business-to-business transaction of $600 or more (cumulative). That's going to be a fucking nightmare in 2012 when it kicks in.

Once again, we're going to be punished with unfunded mandates for owning a business, employing people and generating tax revenue. I have tried to explain the regulatory burden on small businesses but no one seems to give a shit. We're all just seen as "greedy" entities enslaving our employees and living high on the hog.
