California Judge Bans Downer Animals in Food
In National Meat Association v Brown, the Ninth U.S. Circuit Court of Appeals in San Francisco revived a state law forbidding the sale of meat from pigs and cows too sick or injured to walk.
The state already had stricter laws than the federal government, but it had been argued that California could not enforce a stricter law than the national law. The California state Legislature enacted a law in 2008 banning the sale of meat from "downer" cows or pigs, those unable to walk. Such animals are often diseased.
The Legislature had viewed an undercover Humane Society of nonambulatory animals being treated cruelly in a California slaughterhouse. The court not only required that they not be sold for meat, but that they be humanely euthanized, and made it illegal to abuse the animals.
The court called the argument that states could not mandate higher than federal minimum requirements for slaughterhouses "hogwash."
